The March 13, 2000 meeting of the Zoning and Annexation Committee was called to order
by its Chairperson, Council Member Karen L. White at 3:30 p.m. in the Council informal
meeting room.
Persons in attendance included Council Members: Coleman, Varner, Aranowski, Kelly,
Pfeifer, Ujdak, Kirsits, White and King; John Byorni, Velma Boski, Larry Magliozzi,
Kathy Baumgartner, Jon Hunt, Robert Hunt, John Oxian, Mary Singleton, Steve Olivi,
Terry Lang, Greg Kil, Ed Talley, Don Fozo, Carl Littrell, Gary Gilot, Terry Bland of the
t+outIj Ir* tbuiu and Kathleen Cekanski-Farrand, Council Attorney.
Council Member White noted that the members of the Committee included Council
Members Ujdak, Varner, Coleman and herself.
Council Member White noted that the first item on the agenda was to review Bill No. 5-00
which is a rezoning request for the property located at 1601 Kemble Street.
Mr. John Byorni, Assistant Director of Area Plan noted that the request received favorable
recommendations from the staff and the Area Plan Commission. He added that there was
one(1) person in opposition at the Area Plan Commission meeting.
Kathy Baumgartner of Housing Development introduced Steve Olivi and Greg Kil to the
Committee and noted that they are working on the project with her. She stated that the
rezoning was necessary in order for her housing project to move forward. She stated that in
light of the concerns raised by Mrs. Boski that the two (2) windows on the first floor
would be glass block, that the bedrooms would be on the second floor, that they would do
all snow removal and would request that residents park away from the alley. She
suggested that perhaps a sign for Mrs. Boski's drive "Do Not Block" could be posted by
the city.
Velma Boski stated that she has lived in the area for 62 years. She stated that this is an
older neighborhood where the homes are built too close to one another.
Mary Singleton stated that Mrs. Boski does not drive and that she assists Mrs. Boski and is
concerned about ingress and egress and blocking of the alley by the new tenants.
Council Member Aranowski stated that the Housing Development Corporation board has a
good track record. He stated that he will make sure that they live up to their commitments
with regard to landscaping and being a good neighbor. He noted that Rum Village
Neighborhood Association is in favor of the rezoning from its current "C" commercial
status.

Council Member King questioned how many units the Housing Development Corporation
has throughout the community. Ms. Baumgartner noted fifty-six.
Council Member Ujdak inquired of Mr. Byorni the types of uses which would be permitted
under the current zoning classification. Mr. Byorni stated that retail uses, offices, car
repair centers, etc were all permitted. He further noted that currently the parcel is not zoned
to a current site plan. Council Member Ujdak noted that he had been in contact with Mrs.
Bosh regarding his concerns, and in light of the assurances from the Housing
Development Corporation especially with regard to parking, that the rezoning would be an
appropriate use of the property.
Council President Pfeifer noted that in the many other Housing Development Corporation
projects they have been good neighbors and she has no reason to believe that they would
not be in the instant case.
Dr. Varner inquired about the project. Ms. Baumgartner stated that there would be 1,300
square feet per nth the units being stacked per the Fire the units. The units are of a

Following discussion, Council Member Ujdak made a motion, seconded by Council
Member Coleman that Bill No. 5-00 be recommended favorably to Council. The motion
passed.
Mr. Oxian,President of the Historic Preservation Commission, requested that Bill No. 11-
00 a request to establish the Angela Boulevard Bridge as an historic landmark be continued
until the April 10, 2000 meeting. He noted that only the bridge rails would be demolished.
The Committee then reviewed Bill No. 00-25 which is a written fiscal plan and policy for

The annexation area is
and consists of 86.569 acres. The area is proposed to be zoned "A" single family
residential. His department is currently developing a system to address the assigning of
costs.
Council Member King inquired about city services. Mr. Magliozzi stated that the lines for
water and sewer are in the area. The top coat paving is not complete but the streets will be
built to city standards.
Council Member Ujdak inquired about the roads and drainage in the area. Carl Littrell,
City Engineer,stated that the concept and design for the area was acceptable. The project
has received proper IDEM permits. The county has not done any inspections however the
city has tested the sewers for quality and grade. The project failed the initial testing for
leaks(an air test)which resulted from a manufacturers defect in the pipe fittings. It passed

The City could request additional bonds then the usual three (3) year period or in larger
amounts if there are concerns.
Council Member Ujdak inquired about the pressure testing of the sewer lines. Mr. Littrell
stated that the grades have been shot and no backups are contemplated. He stated that the
water and sewers have been accepted but the roads have not been. The base coarse might
have to be replaced in order to meet city standards. Mr. Littrell stated that there are proper
measures in place between the bonding requirements and term to make the developer
comply with all applicable standards.
Following discussion, Dr. Varner made a motion, seconded by Council Member Coleman
that Bill No. 00-25 be recommended favorably to Council. The motion passed.
The Committee then reviewed Bill No. 00-26 which is the fiscal plan and policy for
services for the proposed Staszewski Annexation in German Township.
Mr. Larry Magliozzi made the presentation and provided the following replacement pages
to his report: 3, 6, 7, 8, and 11 (copies attached). He noted that this is a City initiated
annexation and that the property owners are in favor of the project. The annexation area is
located on the east side of Olive Road north of Cleveland Road and consists of .50 acres.
It currently contains a single family residence which would be demolished by
i Redevelopment.
Following discussion, Council Member Coleman made a motion, seconded by Dr. Varner,
that Bill No. 00-26 be recommended favorably to Council. The motion passed.
There being no further business to come before the Committee, Council Member White
adjourned the meeting at 4:17 p.m.
