This being the date set f or hearing on vac a tion r es ol ution No . 2530,
for the vacation of part of the alley wes t of Hill Street , hearing was had.
There were twenty-one persons present remonstrating agains the vacation .
i',Ir . Frank Y.opinski was present to repioesent the remonstrators , and Mr . Walter
Arnold was present to represent the petitioner, Mr . Rocco Simeri , who we.s
also present .
Mr . Arnold gave a short resume of the matter , up to date .
Mr . Willic:.ms informed those present that an estimate of the cost of building
a retaining wall and grading the alley had been drawn up , and Mr . Arnold
suggested that Mr . Williams read the roll of the ass~ssments against the
property owners . This was read and there was much discussion of the various

~!rs. Dinan: '.le are all against closing this alley, but we c ant pay any sueli
costs as that to open it up.
!'ll's . Miller: Just what is the reason he wants this alley closed .
!.r. Arnold : Because it is unsanitar y and a dumping ground.
Mr . Simeri : Everyone uses the alley to dump rubbish and tin cans . No one
ever has anything hauled away.

:·rs. Dinan: I have my as~ es and rubbish hauled away and pay $6 .00 a year to
have it done .
ll1r. Arnold : That is beside the question. The question is whether in the
Board 's opinion, t he alley should be closed, or whether the alley should be
improved. I have told you that Mr . Simeri is willing to pay his share of
the cos-e:-.
Mrs . Willer : He shoul d , he is the one that caused the condition .
Mr . Tirotti : I have known Rocco Simeri all my l ife . I worked for him for
some time . I know that the alley was open and horses and buggies used to
go down the full length of i t all the time , until Rocco Simeri took dirt
out until it was way below the street level •

all against it. Most of them like my mother, have not the mo ney to put into
improvin~ the all ey at such a high cost . My mother has nothing except what
my brother and I give her . 1 y brother is in the army , and my mother gets
$37 .50 from the g overnment . If the improvement goes through and she is unablE
to pay the assessment, I suppose she would get thrown out of her house. After
all f;33000. 00 i s a l ot of money . Few o t _ ese people ould be able to pay
the amoun t it wou l d co s t . I t hink the all ey s hoµld be l eft the way i t is .
Mr. Williams : How long has it been since the alley was a cfessible .
Mr . Tirotti : 8 years .
Mr . Simeri : 15 years . I have lived there 30 years .
Mr . Tirotti : You said the W.P.A. took the dirt out , the W.P.A. was only in
operation 8 years ago .
!Jr. Arnold: Again I wish to refer to Mr. Simeri 's statement that he is willi
to pay his share of t he cost. 11 he asks i s t hat the oar ta~e action at
this time and either make t hi s a public utility or close it up .
Mr . Tirotti : Mr . Arnold, why not have IVIr. Simeri put the alley in the con-
dition it was before it was ruined.
Mr . Arnold : I do not know the Board 's wish in this case .
Mr . Tirotti : I know that these people can not pay the asseswent on their
property .
Mr . Arnold : That is irrelevant .
Mr . Kopinski: Its relevancy Mr . Arnold, is in the fact that these people do
not wish the alley closed. I think whenever anyone comes before the Board
~1 a matter of this kind they should come with clean hands .
,ir. Arnold : This is not a question of whether Mr . Simeri wants something, but
whet:1er the Board decides what is to be d-:,ne .
Mr . Kopinski : The quest ion :i:s 'Nhether 1, r . Simeri wants something and you
know it .
Mr . Jensen : Mr . Arnold, if the city wanted that alley opened up, why didnt
they have it opened when they had the N.P.A. working on every other alley in
South Bend. I tried to get that alley opened up . They just laughed and said
it couldnt be done . It must only be about 300 feet that needs to be taken
out , and it wou l d only cost about ~t300 .00 to open the alley a ll the way down .
Mr . Arnold: Then what makes the cost mentioned so much greater .
~r . Jensen: The retaining wall .
Mr . Arnold : 1Nhy should that wall be made now.
Mr . Jenson: Mr . Dinan gave a p iece of property to the city so there is plenty
of room where an alley could be made.

Mr. Simeri : I would give you 1~5000 . 00 to open the alley up .
l\!r . Jensen : I could make money.
Mr . Arnold: And could you make it safe.
::,1r . Jensen : I would not want to make a retaining wall . I Could not do it .
Mr . Kpinski : This has nothing to do vith the refuse and unsanitary conditions.
When I went out there all I could see was one little pile of tin cans about
five or six years old. I did not see any refuse of any kind .
Mr . Arnold : At the last meeting some one admitted putting refuse in the alley.

Mr. Pola : ,'!hen I put ashes out I put them on my lot .
Mr . Simeri : You ,put them on my lot . _

Mr. Simeri : I have s 0en many people put things out on my property .
Mr . Kopinski : Is a part of that property a pie ce that was vacated, a pieee
that was given to the city to be used as a park .

up vith his ma)erial and stuff. It ·as suppo sed to be fork ds , but a kid
cant go across it without being reprimanded.
Mr. 'Nilliams: It was undoubtedly advertised in the paper the same as this
one was .
It doesnt seem that the property ovmers should be held to
stand the cost of the expenses in making the alley a public utility.
Mr. Tirotti : I dont understand why the city considers doing this at this
time, why didnt they use the ·N .P.A . It doesnt seen right to 'do it now while
there is a war on.

Mr . Arnold: That is not the question.
Mr . Tirotti : That is absolutely the question . 1ir Simeri created the conditic

lir . Simeri : How many times do I see them throwing stuff in the alley . I
tell them not to throw stuff in the alley.
Hr . Tirotti: I do not know who would throw stuff in the alley , Haybe the

Mr . Kopinski:. mr . Simeri, if the city decided to improve the alley what
would prevent the people from throwing things on your e round.
Mr . A~nold : The Civil authorities would prevent it •

Mr . Tirotti: Here it will be a success.
Mr . Arnold: A few people mi ght do the r part . The issue is to e:!.hher
improve the alley or close it up.
Mr . Tirotti: I think I can answer for the rest of them . ·.ve do not feel
that we should have to pay for something that woule. benefit oneman,'and
if the alley is vac ated it will close it up for all of them. It has been

l'.'!rs . r~iller: Yes, Rocco Simeri built them across the alley to his property ,
Even children are rep~imanded for eoing through there .
l!r . Kopinski: I will say again I fail to see how any improvement could
help the situation, refuse could be thrown t here even after the alley was
improved.
l.~r . Arnold : May I see the pictures that were submitted as evidence at the
last meeting.

}trs . Miller : Ho st of those pictures are oi' stuff on Rocco 's property .
All stuff he has stored there.
lTr. Reeves:. All those rats come from the wood stored on Mr. Si..rneri's lot .

llr . Walker: Yes they do. Nhere wood is accumulated there will be rats.

Mrs. Miller: I would like to say a gain that we have not been using that fo :
a dunping ground. Children might throw things down there sometimes. His
own children throw thing s down there.
1\Tr . May: I would like to make this observation. From what little I have
heard, I can not see where the closing of this alley is go ing to serve any

blic :-· _ -se or where it will be of any publj_c benefit. And I think
t hat is --· sole question to be considered here .

Mr. r.:a-: I would like to make this additional observation. I cannot see
where :_.e vacating of tbms portion of t he alley or the maldng of this im-
prove:-:ent is going to eliminate the throwing of cans or rocks down there .
Children have always been the same . egardless of the decision you are not
goin: to eliminate that .
Jo s . Simeri:He promised the people in the neighborhood he would put a wall
in v1hen he took the dirt out . He never did that but he promised. Nine-ten
years ago when he took the dirt out he say he put in a big wall . He never
did that . I put in a wall to my own pproperty.
Mr •. Walker: 'Nhen I moved there the people that lived there before left g
pile of rubbish there. I knew a man that hauled rubbish and I had hiM come

Mr •. Tirotti: Mr . Walker is Mr . Simeri digging any more under your wall ,
Mr. Walker: He isnt digging there any more . I braced it up since then .

Mr . Kopinski: If it is your wall, d id you take steps to protect his property

. :rs. I:iller: May I make a suggestion that we L:ave it just the way it is unt
afte-r the war . It has been this way for a nmnber of years now .
I,"r . Arnold: If the Boards decision is to close the alley, and the alley is
closed at this time, and if the people wish to open it up after the war it
could be again opened up . Action taken by a previous Board can be rescinded .
Mrs . Dinan : I can just see it opened up once it is closed.
Mr . l~pinsld: I would like to make one parting remark. I think to have the
situation so everyone understands •it we should keep two things in mind. That
no benefit will be gained by the closing of this alley except by Hr . Simeri
al one . And how vill you stop the so called nuisances that are complained abo
now, by putting in this improvement. Those are the only tv,o ~uestion, in ny
opinion, berore the Board.

Mr . Kopinski: These people have made an eff-ort to talk this matter over .
The rest is up to the Board.
Mr. Williams: Does any one else have anything to sayq We will discuss the
matter fully with Hr . Levy and will give you the decision at our next Board
