RESOLVED BY THE BOARD OF PUBL I C WORKS OF THE CITY OF
INDIANA: That, it is desirable to vacate the following;

FIRST ALLEY NORTH OF FORD STREET, from the west line of Brookfield
Street to the east line of the alley west of Brookfield Street, also
from the west line of the alley west of Brookfield Street to the
east line of Grant Street .
The following property may be injuriously or beneficially effected
by such vacation;
Lots 160 to 168 inclusive and Lots 188 to 196 inclusive in 2nd Plat
of Summit Place Addition.
Notice of this resolution shall be published on the 20th day of
February and on the 27th day of February, 1942 , in the South Bend
Daily Tribune and the Weekly Mirror .

on said resolution having been set for 10.00 A. M., on the 9th day of

ively, and being now 10 :30 A. M. on March 9 , 1942 and no remonstrances
having been filed with the Board, and no one having appeared in opposition
to said r esolution, it was moved, seconded and unanimously carried
that the resolution #2512, vacating said alley be finally adopted and
said alley be vacated.

April 13, 1942 at 9:00 A. M. Two members were present, Mr. Harry S.
Driggs being absent. Minutes of the last meeting were read and approved.
Mr Clyde E Williams City Engineer, filed primary assessment roll
showin~ awards ;nd damage~ and assessments of benefits in the matter of
the vacation of alley norty of Ford Street from west line of Brookfield
Street to the east line of the alley west of Brookfield Street , al. so
from the west line of the alley west of Brookfield Street to the east
line of Grant Street.

In the above named assessment r6ll, the Board hereby orders that
it will meet in the City Hall at 10:00 A. M. on May 4, 1942 for the
purpose of hearing and receiving remonstrances from all persons
interested in or affected by said Vacation Resolution #2512, and
the Board further orders that notice of said hearing be advertised
in two newspapers in South Bend, on April 17, 1942 and April 24,
1942, and that notices together wi th the amount of damages awarded
and benefits assessed be addressed to the property owners, according
to law.

May 4, 1942 at 9:00 A. M. Two members were present , Mr. Levy being
absent. Minutes of the last meeting were read and approved.
This being the date set, hear ng was held on the assessment roll
showing the award of damages and the assessment of benefits in the
matter of the vacation of alley north of Ford Street from west lineoof
Brookfield Street to the east line of the alley west of Brookfield
Street, also from the west line of the alley west of Brookfield Street ·
to the east oine of Grant Street, same being Vacation Resolution #2512 .
In the above named assessment rGll, no rernonstrators appeared
and no written remonstrances were filed, the Clerk of the Board
submitted proofs of publication of notices and same were f ound
sufficient and the Board, therefore, finds that the several lots
and parcels of land have been benefitted and damaged in the amounts
shown on said roll. The Board, therefore, decides to take final
action on said assessment roll and declares same in all things ratified,
confirmed and approved without modification, and the proceedings
closed and the alley vacated upon receipt of the amount of benefits
assessments from the various property owners so benefitted, and all
proveedings had with reference to said alley vacation are hereby
sustained.
