RESOLVED BY THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND, INDIANA: That it is
desirable to vacate the followine,:

Comes now your petitioner, Ohicago, South Shore and South
Bend Railroad, an Indiana corporation, and respectfully represents
and says:
First. That your petitioner is the owner in fee simple
of the following described real estate in St. Joseph County,
Indiana:
Lots Numbered Seventy-six (76), Seventy-seven (77), Seventy-eight C78) Seventy-nine (79),
Eighty (80), Eighty-one ta1), Eighty-two (82),
Eight -three (83), Eighty-four (84) and Eighty-

Second. That the above described real estate, together
with the four (4) lots in said Sub-division number~d consecutively
from Eighty-six (86) to Eighty-nine (89), inclusive, a.re bounded on

Fifth. That between Lots Seventy-six (76), Seventy-seven

which is not ed, not capable of being used, and which your
petitioner believes will never be used.

used, and which your petitioner believes will never be used.
Seventh. That across said alleys, the track of your
petitioner extends, in accordance with franchise granted by the
City of South Bend and the State of Indiana.
That for the convenience of this Honorable Board, your

question in order that your Board may the better understand the
exact location of the alleys sought to be vacated.
Your petitioner resepotfully prays that the alley running
