Brothers Manufa.ctui•ing Company executed tmder date of

20 ' strip of land between Tutt and SWygart Streets, that
said company agreed to give to the City in place of the
alley covered by said Vacation Resolution No . 7.
Inasmuch as the agreement which involved the
ma.king of this conveyance was consmmnated with the Board
of Public ,orks, we take it that it is proper to make the
delivery of said deed to your Board, in order that it may
have proper knov1ledge and notice of the completion of the
agreeroont on part of the said Studebalrer Brothers T.a.nufactu-
ring Company.

Petition of the Studebalcer Brothers Manufacturing Company
f'or vacation of alley and portion of Street.
The undersigned, St de a er Brot ers ·anufacturing Co any,
would respectfully petition your HonorablA Board for the vacation of a
certain short alley bounded on all sides by real property owned bY
them, and for the vacation of a portion of the East end of Swygart
Street, bounded on the North, East and south bY real property now owned
qy them , to-wit:
1st: An alley fourteen (14) feet in width running North and
South from Tutt Street to SwYgart Street , being the East fourteen (14)
feet of the west twenty (20) feet of Lot No . TWentY-five (25) in Elliot
'rutt •s Addition to the City of South Bend, and the East fourteen (14-)
feet of the west twenty (20) feet of Lot No . Twenty-eight (28) in
George w. Swygart•s Sub-division of Banle out Lots Nos . Sixty-three (63)
and Sixty-four (64) of the First Plat of out Lots of the Town, now City
of south Bend, platted by the State Bank of Indiana, and being the same
strip of land heretofore conveyed by the said studebal{er Brothers
Manufacturing company to the :M:unicipal City of south Bend, by warranty
deed dated March l~th, 1905, and recorded in Deed Record 131, page 258 ;
2nd: That portion of Swygart Street bounded on the west by
a line drawn from a point twenty (20) feet East of the south West corner
of Lot No . TWenty-seven (27) in swygart •s Sub-division above described
due Sou th to the south line of Swygart 18,t reet, and on the East bY a
line drawn from a point twenty (20) feet East of the south rest corner
of Lot No . TWenty-eight (28) in said SwYgart•s Sub-division due South
to the Sout h l ine of said SWYgart Street.
The whole territory requested to be vacated herein being more
and Sixty-four ( 64) of the First P+at of out Lots of the Town, now City of South Bend, platted by the State Banl< of Indiana, and being the same strip of land heretofore conveyed bY the said Studeba.Ker Brothers Manufacturing Company to the Municipal City of south Bend, by warranty deed dated March l~th, 1905, and recorded in Deed Record 131, page 258; 2nd: That portion of swygart Street bounded on the west by a line drawn from a point twenty (20) feet East of the South West corner of Lot No . TWenty-seven (27) in swygart •s Sub-division above described due South to the South line of Swygart ,s,treet, and on the East bY a line drawn from a point twenty (20) feet East of the south test corner of Lot No. TWenty-eigbt (28) in said Swygart•s Sub-division due south to the South line of said Swygart Street. executed a deed to the MUnicipal City of south Bend, dedicating said
strip for the uses and purposes of a public alley, and the general
public would therefore 1n no manner be discommoded or prevented from
enjoying all the rights of passageway that they at present enjoy; and

property and to add to the taxable value of the City, and said vacation
