Notice is hereby given that the board of public works of said city at a meet-Ing of said board held on the 12th day of J uly, 1904, adopted a resolution for the vacation of a public street describ-ed as follows: All of that part of Foster street which ls described as follows: Com-mence on the south line of Howard street at the northeast corner of lot 11, In Stanfield & Foster's addition, thence east on the south line of How-ard street to the northwest corner of lot 12 In said addition: thence south 198 feet to alley; thence west on the north line of alley produced to the easterly line of )<iles avenue; thence 1 northwesterly on easterly l!ne of Niles avenue to the southwest corner of lot 11 In said addition; thence north to place of beginning. Hibberd, is the owner in fee of the follow- ing described real es t ate in the City of South Bend, to-wit:-Lots Numbered Eleven (11) Twelve ,12) and Thirteen {13), as shown on the Recorded Pls.t of Stanfield & Foster• s Addition to t t e City of Sout h Bend, Indiana. That said Lot No.11 is a triangular lot, bounded on -the North by Howard Street, on the E&.st by Fost e r Street and on the Southwest by Niles Avenue. That that por.tion of F oster Street running South from the South lir:e of Boward Street to the intersection with the North line of the first a l ley running East from Niles Avenue between Tots 10 and 1 2 and 13 in said Addition and bounded also partly on the South West by Niles Avenue, is less than one block in length; that said portion of said Street has never been i:rrp roved by the City of Sou th Bend, not h as i t even been gene rally used by the public as a thoroughfare. That your petitioner believes that no person or persons will be inconvenienc8d or damaged by the vacatior: of the portion of Foster Street above described, as your petitioner owns all of t h e real estate abutting on that portion of said street herein asked to be vacated. That the portion of Foster Street herein asked to be vacat-ed hasnever been travele~ nor g enerally used by the public, and the ex- p ens e of imp roving the s ame and kee; ing it i n rep air and in condition for travel, would greatly exceed tr:e benefits accruing to the public and the citizens of South Bend from the use thereof. That if' said portion of said street is vacated, the title to the vacated portion thereof will reve rt to and Test in the owner of City of Sout.r: Bend will receive a revenue theref'ror.i instead of beir.f compelled to expend mon e;: to keep the s ame in repair for public use.
