The vacatio·n of st . J o seph street will give to Mary Barrett real
estate worth $2,000.00 . The opening of east Marion street to the st .
Jos eph River will not take real estate from Mary Barrett worth more than
$100.00. we feel that the st. Joseph River is a beautifU1 stream of
water and is a decided advantage to have a stre et leading thereto, and
we object t o the closing of both st. Joseph and east Marion s t reets .
It was the intention of the Rockstroh heirs to open up Marion street to
the river, and the plat made by them, before land was sold to Christi an
Soens and Mary Barrett, of Rockstroh 1 s second Addition and recorded i n
Plat Book seven, page 62, surveyed by l!e i ghan in October, '99, and ack-
nowledged October 23, 1sg9, and adopted by t he Common Council November
15, 1899, shows the extention o:f Marion Street . The ground asked to be
vacated for in St . Joseph: street is worth $2 ,000 .00, while the amount
paid by Mary Barre tt for the two Rockstroh lo,ts and -portion of the
street was ~$1,ooo .oo. The experience of the city in opening new streets
warrants us in objecting to the closing of a street already had, as we

George Rockstroh and others by their warranty deed dated Octo.ber
2, 1899, and recorded October 14, 1899, and recorded in Deed Record 112
on -pages 588, 589, 590, conveyed to the tmd.ersignea. the tract o~ ground
lying north of the north line of Marion street and east of st. Joseph
str4et, and now accup1ed by me for a briclc ya:ra. and said deed contained
the following clause,• Granters giv~• grantee and convey the right of
way over their land;.;Navarre and Marion streets, for ingress and egress
to lands herein conveyed to said grantee·.,_• Afterwards on October l '7,
1899, George Rockstroh and others by warranty deed, recorded in Re cord l'/ol/1--
of Deeds on pages 592, 593 conveyed. ·to Mary Barrett certain real estate
and included in that deed the ground which would be in Marion street
if extended east to the river. The vacation asked for by Mary Barrett
leaves a cul-de-sac in Marion street east of st. Joseph street~ and
creates some doubt about my right to pass over the ground vacated.
The equitable thing to do is, to vacate Marion Stree t .i'rom st. Joseph
street east, in which vacation Mary Barrett and I woul~ be treated alike
as we should be. At the time of the purchase by myself and Maey Bar-
rett, there was a plat 1n the han's of Jasper Garst, ullo was agent :for
the Rockstroh estate, showing the dedication and extending of east
Marion street to the st. Joseph River. I object to having Marion Street
cut up for the sole purpose of giving M:ary Barrett frontage at my-ex-
pense.
