PURPOSE OF REQUEST: Appropriation of money to pay legal expenses for litigation pertaining to 300 E.
LaSalle and pursuant to I.C. 36-7-14-12.2(a)(11) - (12).
SPECIFICS: We are requesting $150,000 from the River East Development Area TIF to cover legal fees
related to the litigation initiated against Commerce Center Development LLC. On January 12, 2023, the
Commission authorized the City legal department to engage with outside counsel and enforce the terms
of the development agreement that is the subject of the litigation.
Staff recommends approval of this appropriation of funds.
