Hearing Case Number 2022-01 City of South Bend v. Shaquille Delaney (Order
Issued February 22, 2022)
Animal Control Commission Members Present: Dr. M. Covey, Pam Wesolowski,
and Barb Leavell
City Staff Present:Lindsey Cuellar -SBARC Shelter Manager, Tom
Panowicz-Attorney for SBARC, and Kylie Connell and
Ashley Snidecki- Attorneys for Commission
1. The hearing was called to order by the Hearing Officer at 1745 hours.
A. Hearing regarding Habitual Animal Offender residing at 1036 West
Oak Street, South Bend.
B.Respondent is Shaquille Delaney.
C. Case was last heard in March of 2021.
D.Determination was also attached sent to Respondent.
2. Service was made and accepted by Hearing Officer.
3. Tom Panowicz called SBARC Manager Lindsey Cuellar to give testimony
regarding the this case.
A. Respondent was given two weeks from date of last hearing in March
of 2021 to fix fence.
I. SBARC went to address to check on fence, which was fixed.
B.One dog was confiscated from the residence, King. Not Boss.
C.Between dates of April 18 and April 27 five calls were made to
SBARC regarding dogs running at large, along with Respondent’s
girlfriend’s dog.
D.On April 27, 2021 two dogs were running loose on Oak Street and
at that time King was seized.
E.January 2022 a notice was given regarding the dogs running at
large, Respondent tore up notice.
F.Two weeks after the incident SBPD executed a warrant seizing
three puppies and 1 juvenile dog.
G.After the determination in 2021 there were at least three more
violations.
4.Respondent was absent due to being incarcerated at St. Joseph County
Jail but service was also provided there.
5.A motion was made by the Commission to label Respondent a Habitual
Animal Offender with a lifetime ban on owning any animals.
A.All dogs within the residence will be seized and should any dogs
be found during this ban they will be seized also.
B.This finding of fact applies to all addresses within South Bend
with regard to Respondent, whether it be owned by Respondent or a
rental.
C.Motion was made and carried by all on Commission.
