This permit is granted in accordance with the application filed on 21 October 2022. Effective on: 23 January, 2023 Expires on the: 22 January, 2028 Any violation of the terms and conditions of this permit shall be deemed a violation of the City of South Bend Municipal Code and will subject the permittee to the sanctions set out in section 17-11 through 17- 13 of the Municipal Code. The permittee shall file an application for a renewal permit, a minimum of 90 days prior to the expiration date. South Bend Ethanol, LLC is a is classified as a Significant Industrial User (SIU) as defined in the South Bend Municipal Code. South Bend Ethanol’s requirements were reviewed for necessary changes to ensure the industrial permit remains legally substantiated. After review of requirements and historical data, some monitoring frequencies were changed. Ammonia, Nitrogen and Phosphorus monitoring frequency has been upgraded from a semiannual basis to a monthly basis. No other significant changes were made. Monitoring Frequency 1.The following parameters shall be monitored at the frequency and with the sampling type stated below. All measurements, tests, and analyses of the characteristics of water and wastes to which reference is made in this permit shall be conducted using the methods and procedures approved in 40 CFR 136 and amendments thereto, unless otherwise specified in an applicable Categorical Pretreatment Standard. South Bend Ethanol LLC Industrial Discharge Permit 3 PERMIT BRIEFING MEMO 1. Facility Description South Bend Ethanol, LLC engages in the conversion of corn to denatured, fuel-grade ethanol by processes of fermentation, distillation, and drying. As a by-product of ethanol production, SB Ethanol will also produce Distiller’s Dried Grain & Solubles (DDGS) and corn oil which will be sold for livestock feed. South Bend Ethanol’s facility is designed to operate 24 hours per day, seven days per week, with two twelve-hour shifts. SB Ethanol currently has 50 employees. Seasonal variation in production is not anticipated. 2. Discharge Description: Wastewater streams discharged at Sample Site Outfall # 3201 originate from three (3) locations. They are: Source of Wastewater Average Discharge (gpd) Maximum Discharge (gpd) 1 Process Water – Combined in the Neutralization Holding Tanks, includes wastewater from fermentation and water pumped from containment dikes following precipitation 300,000 750,000 2 Equipment/Facility Wash-down 110,000 200,000 3 Reverse Osmosis reject wastewater 10,000 20,000 Total average discharge flow 420,000 970,000 All of the wastewater is combined, treated, and discharged at the main lift station which is located at the southeast corner of the property along Calvert Street, and is the location for compliance monitoring. 3. Sample Site Description Sample Site Outfall # 3201 is located inside South Bend Ethanol’s lift station on the far southeast corner of SB Ethanol’s facility. The discharge is metered by South Bend Ethanol’s Doppler System. As the lift station fills up there are two pumps set at different levels in the pit to pump the discharge into the City of South Bend Sewer System. Inside the lift station there is a T-line for the collection of compliance samples. South Bend Ethanol’s sampler is connected to one end of the T-line and the Pretreatment staff attaches the Pretreatment Program sampling tubing to the other end of the T-Line. Both composite and grab samples are collected through the T-Line tubing using the pump in the auto-sampler to draw the sample into the bottles. The sampler flow monitor is connected to South Bend Ethanol’s flow meter in order to collect a flow proportioned sample. South Bend Ethanol LLC Industrial Discharge Permit 4 4. Wastewater Treatment Wastewater Treatment consists of a surge pond, DAF system, dewatering system, Ferrous Chloride addition or other Control Authority approved chemical addition and pH neutralization. 5. Classification South Bend Ethanol is classified as a Significant Industrial User (SIU) as defined in the South Bend Municipal Code due to its wastewater flow in excess of 25,000 gpd. South Bend Ethanol is a Category “A” industry, due to its process flow over 100,000 gpd. South Bend Ethanol is not a Federal Categorical User. Although they plan to engage in organic chemical production, South Bend Ethanol is not covered by 40 CFR 414 because ethanol is produced using fermentation. According to 414.11 (e) “The provisions of [40 CFR 414] do not apply to any process wastewater discharges from the manufacture of organic chemical compounds solely by fermentation processes.” 6. Calculation of Limits South Bend Ethanol must meet Local Limits at their discharge location. Local Limits from the South Bend Municipal Code are applied without modification to South Bend Ethanol’s total facility effluent, with one exception: South Bend Ethanol was granted a specific variance setting the upper pH limit to 12.0 S.U. in a 1995 amendment to Chapter 17 of the South Bend Municipal Code. The upper pH limit of 12.0 was granted in order to assist in keeping pH high in an additional effort to control hydrogen sulfide. This variance applies to South Bend Ethanol as well because the industrial process, as described in South Bend Ethanol’s permit application, and the surrounding situation is identical to the conditions that gave rise to this variance. 7. Monitoring Frequency Monitoring frequencies are based on South Bend’s US EPA approved Industrial Pretreatment Program monitoring plan. 8. Industrial Operator Certification Requirement Operator Certification Requirement: D Industrial operator certification requirements are based on the criteria listed in Indiana Administrative Code, Title 327, 5-22-5.
