The May 10, 1999 meeting of the Zoning and Annexation Committee was called to order
by Council Member Charlotte Pfeifer, Vice-Chairperson at 4:05 p.m. in the Council
informal meeting room.
Persons in attendance included Council Members: Aranowski, King, Varner, Kelly,
Pfeifer, Sniadecki and Coleman; Terry Bland, John Byorni, Lew Powell, Carl Littrell,
Robert Forrest, Bob Palmiter, Larry Magliozzi, Ron Johnson, Catherine M. Brucker and
Kathleen Cekanski-Farrand.
Council Member Pfeifer noted that the first item on the agenda was Bill No. 26-99 which
would annex and amend the zoning ordinance for certain property located in German
Township, commonly referred to as the Fiskars Properties, Inc., No. 2, 23870 Brick
Road, South Bend, Indiana 46628.
Mr. Magliozzi noted that the Bill is a voluntary annexation of approximately one-half acre
of property. The Council will also be reviewing its Fiscal Plan attached to Resolution No.
99-36(attached).
Mr. Byorni noted that the Bill received a favorably recommendation from the Area Plan
Commission as well as the staff of the APC.
Mr. Palmiter, the petitioner, noted that the rezoning and annexation would allow the
expansion of his building to seven (7)pods along with increased parking areas.
Following discussion, Council Member Kelly, made a motion, seconded by Council
Member Varner, that Bill No. 26-99 be recommended favorably to Council. The motion
passed.
The Committee then reviewed Substitute Bill No. 17-99 which is a rezoning request for the
property located at 1158 Lincoln Way East. Mr. Byorni noted that both the staff and the
Area Plan Commission gave favorable recommendations to this request.
Ron Johnson, the petitioner, made the presentation. He noted that the building, if
approved,would become the law offices of Attorney Joseph Rubin.
Following discussion, Council Member Varner made a motion, seconded by Council
Member Kelly,that Substitute Bill No. 17-99 be recommended favorably to Council. The
motion P assed.
The Committee then reviewed Substitute Bill No. 27-99 which would amend Chapter 21 of
the South Bend Municipal Code, § 21-12.040. Mr. Byorni noted that the Bill is initiated
by the Area Plan Commission and would allow accessory buildings in the "0" Office
zoning classification. Total accessory structures would be limited to 576 square feet or the
existing structure. The Council Attorney noted that the Substitute version includes a height
restriction of fourteen (14') feet. Mr. Byorni noted that this height restriction was
requested by Don Fozo,the Building Commissioner. ,

Following discussion, Council Member Kelly, made a motion, seconded by Council
Member Varner,that Substitute Bill No. 27-99 be recommended favorably to Council. The
motion passed.
The Committee then reviewed Substitute Resolution No. 99-35 which would approve a
petition of the South Bend Board of Zoning Appeals for the property located at 1021-1021
1/2 and 1023-1023 1/2 Lincoln Way West.
Catherine M. Brucker, Assistant Zoning Administrator advised the Committee that the
request received a favorable recommendation at the SBBZA meeting of April 15, 1999.
Mr. Robert Forrest, the owner of the property made the presentation. He noted that he had
lived at the property for many years and was advised by his insurance company that he
must have approval of this special exception for insurance to be issued.
Following discussion, Council Member Varner made a motion, seconded by Council
Member Kelly that Substitute Resolution #99-35 be recommended favorably to Council.
the motion passed.
There being no further business to come before the Committee, Council Member Pfeifer
adjourned the meeting at 4:17 p.m.
