The September 27, 1999 meeting of the Zoning and Annexation Committee was called to
order by Council Member David Varner, at 3:33 p.m. in the Council informal meeting
room.
Persons in attendance included Council Members: Aranowski,Varner, Kelly,Pfeifer, King
and Sniadecki; Bob Hunt, John Broden, John Oxian, Donald Shaum, Jr., Khadijah
Muhammand, Pat Shelton,John Byorni, Kathleen Cekanski-Farrand and Terry Bland.
Council Member Varner noted that the first item on the agenda was Bill No. 48-99 which is
a rezoning request for the property located at 1710 Edison Road.
Mr. Byorni noted that both the staff and the Area Plan Commission give the proposed
rezoning an unfavorable recommendation with the Area Plan meeting taking place on
August 17, 1999. He noted that the staff and the Commission believe that the proposed
use is too intensive for the site. Mr. Byorni also noted that the Board of Zoning Appeals
denied the setback but approved the variance with regard to parking.
Council Member Karl King,the District Council Member for the affected area, noted that
after the Board of Zoning Appeals meeting that a meeting with the neighbors took place. It
was tentatively agreed that the site plan would be revised. Council Member King noted
however that as of today, no new site plan has been submitted, the petitioners have not
contacted the neighbors and the informal agreement has not been honored.
The Council Attorney noted that the Bill could be continued until the Council meeting of
October 11th,but could not be continued after that date.
Council Member Hosinski then joined the meeting and took over chairing it. He noted that
at the current time that he was opposed to the proposed rezoning.
The petitioners then requested that Bill No. 48-99 be continued until the October 11th
meeting.
The Committee then reviewed Bill No. 53-99 which is a rezoning request for the property
located at the northeast corner of LaSalle Avenue and Notre Dame Avenue. Mr. Byorni
noted that both the staff and the Area Plan Commission give the proposal favorable
recommendations.
The petitioner from Pierce and Associates then made the presentation. They showed the
proposed site development plan of St.Joseph Medical Center(copy attached).
Following discussion, Council Member Varner made a motion, seconded be Council
Member Pfeifer, that Bill No. 53-99 be recommended favorably to Council. The motion
passed.
The Committee then reviewed Bill No. 68-99 which would establish an historic landmark
for the property located at 1240 Thomas. Mr.John Oxian made the presentation. He noted
that the property is ranked an "S-11" and was built in 1920.

Following discussion, Council Member Pfeifer made a motion, seconded by Council
Member Varner, that Bill No. 68-99 be recommended favorably to Council. The motion
passed.
The Committee then reviewed Bill No. 69-99 which would establish an historic landmark
for the property located at 1253 Diamond Avenue. Mr. John Oxian made the presentation.
He noted that the home is owned by his brother, was built in 1920 and is ranked an "S-11"
out of 13. Following discussion, Council Member Varner made a motion, seconded by
Council Member Pfeifer, that Bill No. 69-99 be recommended favorably to Council. The
motion passed.
The Committee then reviewed Bill No. 70-99 which would establish an historic landmark
for the property located at 614 Sherman Street. Mr. Oxian noted that the home was built in
1916 and is ranked "S-11". Following discussion, Council Member Pfeifer made a
motion, seconded by Council Member Kelly, that Bill No. 70-99 be recommended
favorably to Council. The motion passed.
The last item reviewed by the Committee was Bill No. 56-99 which addresses the parking
of oversized vehicles in "A" residential districts. Mr. Byorni noted that this was an Area
Plan Commission initiated petition and received favorable recommendations from both the
staff and the Area Plan Commission.
Council Member King noted that he and several members of the City Administration have
been working with members of the South Bend Community School Corporation on the
parking of school buses in residential areas. He noted that many meetings have taken place
and that snow routes have been checked with regard to the proposed parking. He noted
that a companion Bill would also be heard this evening,namely Bill No. 80-99.
Pat Shelton, the Transportation Director for South Bend Community Schools spoke in
favor of the proposed Bill. Council Member King noted that it was a long process, but
with the cooperation of the school corporation, the assistance of Traffic and Lighting and
many others that the Bill addresses the problem in a positive manner.
Council Member Aranowski thanked Council Member King for his work on this measure.
Following discussion, Council Member Pfeifer made a motion, seconded by Council
Member Varner, that Bill No. 56-99 be recommended favorably to Council. The motion
passed.
Council Member Hosinski adjourned the meeting at 3:53 p.m.
