HomeMy WebLinkAbout11-08-99 Zoning & Annexation atoinmtttss Atsport: The Zoning and Annexation Committee i0 t t Common tountf1 of the City of f,out1j ittb: The November 8, 1999 meeting of the Zoning and Annexation Committee was called to order by its Chairperson, Council Member John Hosinski, at 3:35 p.m. in the Council informal meeting room. Persons in attendance included Council Members: Aranowski, Varner, Pfeifer, King, Ujdak, Hosinski and Sniadecki; Citizen Member Doug Carpendar, Kenneth Fedder, Don Fozo, Jerry Zock, Phil St. Clair, Bob Hunt, John Oxian, Charles Leone, Mr. Patrick D. Myers, Catherine M. Brucker,John Byorni, Kathleen Cekanski-Farrand and Terry Bland. Council Member Hosinski noted that since the petitioner was not present the first item on the agenda that the Committee would review Bill No. 78-99 which is a rezoning request for the property located at 2313 West Ewing. Mr. Byorni noted that both the staff and the Area Plan Commission give the proposed rezoning a favorable recommendation with the Area Plan meeting taking place on October 19, 1999. Mr.Jerry Zock,the petitioner,then addressed the Committee. He plans to use the property for the construction of a single family home. He noted that it is a heavily wooded area with a 30' drop and that the alley on the plat is a paper alley only. In response to a question from Council Member Ujdak,Mr. Zock noted that the geodesic dome construction is the property of Randy Jones. In light of the tight corner,ingress and egress would be off of Olive and not Ewing. Mr. Don Fozo,Building Commissioner, stated that the Board of Zoning Appeals approved the variance needed for the construction. Following discussion, Council Member Pfeifer made a motion, seconded by Citizen Member Carpendar that Bill No. 78-99 be recommended favorably. The motion passed. Council Member Hosinski noted that Bill No. 79-99 has been requested to be withdrawn from further Council consideration by the Jewish Federation of St. Joseph Valley (November 4, 1999 letter from Marilyn Gardner,Executive Vice-President attached). The Committee then reviewed Bill No. 81-99 which is a rezoning request for the property located at 705 Lincolnway East. Mr. John Byorni noted that the staff and the Area Plan Commission sent the Bill to the Council with a favorable recommendation. Mr. Patrick D. Myers, the petitioner, noted that the site has been in continuous use for apartments since the zoning code was passed. This rezoning would put the zoning in conformance with the existing use. Following discussion, Citizen Member Carpendar made a motion, seconded by Council Member Pfeifer that Bill No. 81-99 be recommended favorably to Council. The motion passed. Zoning and Annexation Committee November 8, 1999 Page 2 The Committee then reviewed Bill No. 87-99 which is a request to establish the property located at 1040 West Washington as an historic landmark. Mr. John Oxian made the presentation. He noted that this was his first "open-ended recommendation". The property in question is the Engman Natatorium which was built in 1921-1922. It was built to model the Culver Natatorium and that of the Chicago Athletic Club. He noted that the building meets the criteria as an historic landmark in that it represents the"character, interest or value as part of the development, heritage or culture" of the city; that it embodies innovative architectural characteristics; and it is suitable for preservation. Mr. Phil St. Clair, Park Superintendent, stated that the natatorium has a long and rich history however it is currently an eyesore to the residents of Washington Street. He noted that his department would like to demolish the building since it is not practical to restore it. He further believes it could be used as a recreational site for Hansel Center. Mr.Don Fozo,Building Commissioner,noted that many sections of the roof have caved in and that the walls are bowing out. Council Member Pfeifer stated that she lives directly across from the natatorium. She has received many complaints about the building. She believes it would be best to raze the building since many people dump trash around it. She recommended that the front of the building be preserved and would make a commitment to work toward that goal. Council Member Hosinski inquired whether a feasibility study had been conducted. He suggested that the preservation of the facade be looked into by the Park Superintendent and the Building Commissioner. He suggested that the bill be tabled to allow such study to take place. Mr. Oxian stated that he has a 1997 letter from the Park Superintendent stating that a feasibility study of the natatorium would be completed in 1998. As of this date, he has not received an update. Following further discussion,Council Member Pfeifer made a motion, seconded by Citizen Member Carpendar that Bill No. 87-99 be tabled and that a report from the Park Superintendent and the Building Commissioner on the feasibility of preserving the front facade of the natatorium be completed before years end. The motion passed. The Committee then reviewed Bill No. 99-110 which would approve a petition from the Board of Zoning Appeals for the property located at 1511 Pulaski Street. Mr. Kenneth Fedder, the attorney for the South Bend Warehousing & Distribution Corporation, made the presentation. He noted that his client proposes to commence a business for the collection, storage and recycling of paper. The Board of Zoning Appeals at their meeting of October 21, 1999 gave a favorable recommendation to the petition. Catherine M. Brucker, Assistant Zoning Administrator, reviewed the findings of fact from the Board of Zoning Appeals and noted that it is being sent with a unanimous favorable recommendation to the Common Council. • Zoning and Annexation Committee November 8, 1999 Page 3 Following discussion, Council Member Pfeifer made a motion, seconded by Citizen Member Carpendar, that Bill No. 99-110 be recommended favorably to Council. The motion passed. The Committee then reviewed Bill No. 99-111 which would approve a petition of the Board of Zoning Appeals for the property located at 231 South Michigan Street. Mr. Charles S. Leone,the attorney for David L.Hab and Lois Busse, the petitioners, made the presentation. He noted that his clients wish to convert an office on the second floor above Dainty Maid Bakery into a 1000 square foot apartment for the use by the owner of Dainty Maid Bakery. Following discussion, Citizen Member Carpendar made a motion, seconded by Council Member Pfeifer that Bill No.99-111 be recommended favorably to Council. Council Member Hosinski was informed that the petitioner for Bill No. 77-99 had been contacted and would be at the 7 p.m. Council meeting. No committee action would take place on that Bill.
