In review by the Division of Engineering, no calculation errors were found in the submitted bids.
All bidders provided the necessary forms and proposed subcontractor utilization that met the
M/WBE goals for each division.
The sum of low bids for all divisions exceeds the 2022 budget for Curb and Sidewalk.
Engineering recommends delaying the award of Division 3 into 2023. Engineering plans to
present this award recommendation separately to the Board of Public Works at a later time and
requests that no award or rejection action be taken on Division 3 at this meeting.
The Division of Engineering recommends award of only Divisions 1, 2, 4, and 5 to Premium
Concrete, in the total amount of $568,005.00.
Engineering furthermore recommends rejection of all other bids for Divisions 1, 2, 4, and 5 only.
As previously stated, no award or rejection action is recommended for Division 3 at this time.
The Department of Public Works has appropriated sufficient funds from Fund 202 Curb and
Sidewalk Division, and Fund 101 Other Contractual Services. A separate purchase order is to be
created for each division:

• Division 2: PR-00020687
• Division 3: PR-00020689
• Division 4: PR-00020690
• Division 5: PR-00020691

PUBLIC WORKS CONTRACT
This Agreement is made and entered into this 20th Day of December, 2022, by and between
Premium Concrete Services, Inc., 712 Richmond St., Elkhart, IN 46516 (the “Contractor”), and
the Board of Public Works (the "Board”).
The Contractor covenants and agrees to make the following improvement, as fully set out in the
Request for Quotations, Standard Specifications, Special Provisions, Plans, and Bid Proposals, all
of which are set forth as a part of this Contract, for:
PROJECT NO. 122-044
DESCRIPTION: 2022 CURB AND SIDEWALK, ROUND II
COMPLETION DATE: SEE SPECIFICATIONS
AMOUNT: NTE $568,005; DIVISIONS 1, 2, 4, 5
FUNDING: PR-00020496
The unit prices for this improvement were those prices as received and accepted by the Board on
the 13th Day of December, 2022.
The Contractor further agrees to notify the assigned Engineer when this improvement is
completed. This notification shall be in the form of a Project Completion Affidavit, signed by the
Contractor. Upon final acceptance of the improvement by the Engineer, the Contractor’s final
estimate will be presented to the Board for final Payment with one (1) copy of the Project
Completion Affidavit and one (1) copy of a Waiver of Lien.
Each of the Parties, by signing below, represents and warrants to the other Party that he/she/it has
the authority to bind the named person or entity to this Agreement.
