Zoning and Annexation Committee

The March 10, 1997 meeting of the Zoning and Annexation Committee was called to order
by its Chairperson, Council Member John Hosinski at 4:12 p.m. in the Council informal
meeting room.
Persons in attendance included Council Members: Aranowski, Pfeifer, Kelly, Broden,
Varner, Ujdak, Coleman, Hosinski, Sniadecki; John Byorni, John Oxian, John Roos,
Charles Hayes, Don Porter, Doug Carpenter, Kenneth Fedder, and Kathleen Cekanski-
Farrand.
The first item on the agenda was to review Bill No. 2-97 which is a zoning request for the
property located 2930 West Cleveland Rd. Mr. Kenneth Fedder, the attorney for the
petitioner made the presentation.
Mr. Fedder noted that the property is owned by.Sobieski Federal Savings and Loan
Association. The zoning request would allow the petitioner to have a financial institution
located at that located with a drive-thru window and ATM machine.
Council Member Aranowski,the 1st District Council Member where the proposed rezoning
is to take place welcomed the petitioner and Mr. Fedder to his district.
Following favorable comments, citizen member Doug Carpenter made a motion seconded
by Council Member Pfeifer that Bill No. 2-97 be recommended favorably to council. The
motion passed.
The committee then reviewed Substitute Bill No. 5-97 which is a zoning ordinance request
for the property located on the 3,500 block of East Keller St. Mr. Charles Hayes made the
presentation. He noted that he is the contingent purchaser of the property with the zoning
request being made so that it can be used for a radio communication tower and related
facilities. He noted that radio towers are needed every two miles in light of the increased
technology for cellular phones.
Mr. John Byorni of the Area Plan Staff noted that the proposed ordinance received a
favorable recommendation from both the staff as well as the commission.
Council President Kelly questioned how many such location are proposed for the city of
South Bend. Mr. Hayes noted that he will be coming g into the City Council on a case by
case basis. However, he did note that there will be multiple users who could utilize a tower
besides cellular phone usage. He noted that the towers are between 100 and 200 feet and
are not self-supporting.
Council Member Hosinski noted that he worked with Mr. Hayes when Mr. Hosinski was
the Town Attorney for Roseland and spoke in favor of the proposed rezoning.
Following discussion, Council Member Pfeifer made a motion seconded by Council
Member Hosinski that Substitute Bill No. 5-97 be recommended favorably to Council.
The motion passed.

Mr.John Oxian of the Historic Preservation Commission noted that Bill No. 11-97 for the
property located at 513 Harrison Ave. would like a 6 month delay. Those noted that the
Area Plan Staff had reviewed the proposed Historic Landmark designation and finds that
the improvement would not conflict with the designation. (Copy of February 10, 1997
letter attached).
Council Member Hosinski noted that Bill No. 46-96 has been withdrawn.
Following further discussion,the meeting was adjourned at 4:30 p.m.
