Zoning and Annexation Committee

The Zoning and Annexation Committee was called to order by its chairperson, Common
Councilmember Tom Zakrzewski at 4:50 p.m.in the Council informal meeting room.
Persons in attendance included: Councilmembers Kelly, Zakrzewski, Washington,
Luecke, Pfeifer,Broden, Varner, Coleman; Don Porter,Bernie Feeney,Don Fozo,Mike
Beitzinger and Kathleen Cekanski-Farrand.
Councilmember Zakrewski noted that the item before the Committee was Resolution No.
96-95 which would approve a petition of the South Bend Board of Zoning Appeals for the
property located at 17924 State Road 23.
Mr.Bernie Feeney the representative for the petitioner made the presentation.He noted that
this is a companion resolution to the annexation which was heard by the City Council in
September. If the petition is granted it would permit seventeen parking spaces to be used in
a residential area. He then showed a proposed site plan to the Committee. Mr.Don Fozo
noted that the petitioner received a favorable recommendation from the Board of Zoning
Appeals and that the house would stay.
The Council Attorney noted that the Council ordinance approving the annexation was
advertised on September 13th and has a 60 day remonstrance period. If a remonstrance
would be filed and if the Council would go forward on the proposed petition this evening
the remonstrance would overrule such a petition.
Following discussion,councilmember Luecke made a motion seconded by Councilmember
n 96-95 be recommended favorably to Council. The motion

5:00 P.m.
