Zoning and Annexation Committee

The September 8, 1997 meeting of the Zoning and Annexation Committee was called to
order by Council Member John Hosinski at 3:45 p.m. in the Council informal meeting
room.
Persons in attendance included Council Members: Pfeifer, Kelly, Varner, Ujdak,
Coleman, Sniadecki and Hosinski;Citizen Member Doug Carpenter, John Byori,Larry
Magliozzi, Don Fozo, Kenneth P. Fedder, Bruce R. Bancroft, Robert L. Gummer, Teria
Chism,Terry Bland,John Peddycord,Ann-Carol Simons and Kathleen Cekanski-Farrand.
The first item on the agenda was to review Bill No. 78-97 which is commonly known as
the North Olive Road Annexation. Mr. Larry Magliozzi made the presentation. Following
discussion, a motion was made and properly seconded that Bill No. 78-97 be
recommended favorably to Council. The motion passed.
The next item on the agenda was to review Substitute Bill No. 66-97 which is a zoning
request for the property located at 3320 Portage Avenue. Mr. John Byorni noted that it
received a favorable recommendation from the Area Plan Commission.
Mr. Kenneth Fedder,the attorney for the petitioner made the presentation. He noted that
the request is being made so that his client, Amouri,Inc. may operate existing retail stores,
conduct office/retail business and maintain an existing outdoor billboard. Following
discussion, a motion was made and properly seconded that Substitute Bill No. 66-97 be
recommended favorably to Council. The motion passed.
The Committee then reviewed Substitute Bill No. 62-97 which is a rezoning request for the
property located at 130 Park Lane Street. Mr. John Byorni noted that it received a
favorable recommendation from the Area Plan Commission.
Mr. Bruce R. Bancroft, the attorney for Memorial Hospital of South Bend, Inc. made the
presentation. He noted that the zone change is being sought to allows "PHC"
professional/health care offices at the location. Following discussion,a motion was made
and properly seconded that Substitute Bill No. 62-97 be recommended favorably to
Council. The motion passed.
The Committee then reviewed Substitute Bill No. 65-97 which is a rezoning request for the
property located at the southeast intersection of Ironwood Road and Inwood Road. Mr.
John Byorni noted that it received a favorable recommendation from the Area Plan
Commission.
Mr. Robert L. Gummer of Extendicare Health Services, Inc. made the presentation. He
showed an architectural rendering and site plan of the area in question which would house a
seniors living campus on 19.6 acres of property. Following discussion, a motion was
made and properly seconded that Substitute Bill No. 65-97 be recommended favorably to
Council. The motion passed.

Under miscellaneous business, the Committee then reviewed Substitute Bill No. 69-97
which would amend Chapter 21 of the South Bend Municipal Code in establishing zoning
regulations for adult care homes. Mr. Byorni noted that this proposed ordinance would
address adult care homes which would have four (4) or less adult residents. Each
proposed location would require a special exception. The Council Attorney noted that this
Bill is a substitute bill with the licensing regulations being set forth in a separate bill. Mr.
Byorni noted that the definition had also been refined at the request of the Area Plan Staff.
Ann-Carol Simmons, Assistant City Attorney made the presentation on behalf of Council
Member John Broden,the sponsor of the Bill.
Council Member Varner voiced concern with regard to the potential concentration of adult
care homes in "A"residential neighborhoods. He suggested that a footage requirement of
such uses in areas be considered. He also inquired into parking and screening
requirements in light of health care staff and visitors. He voiced concerns over the impact
on the neighborhood.Mr.Fozo noted that screening would be necessary if there were more
than four(4)parking spaces required.
Doug Carpenter, citizen member, voiced similar concerns as Dr. Varner with regard to
concentration of use issues,parking and the overall impact to the neighborhood.
Dr. Varner voiced further concerns over the fact that the ordinance does not call for owner-
occupancy. Council Member Pfeifer noted that approximately thirty percent (30%) of the
housing stock in South Bend is rental.
Council Member Coleman noted that in light of the significant and substantial concerns
being raised that the Bill might be referred back to the Area Plan staff for further study.
Council Members Coleman and Pfeifer both recommended that further study and input be

Teria Chism of 1129 East Eisle noted that she had contacted Council Member Broden
regarding the adult care home project. She provided a copy of the "January 1994 Adult
Care Requirments-Home and Community-Based Service Programs--Medicaid Home &
Community-Based Waivers Program" (copy attached)
It was recommended that since this Bill is bein g discussed under "miscellaneous business"
that no formal recommendation i n 1 take place. It was recommended that a continuation

of the Bill in its present form with notification to the Area Plan staff may be the best action
to take at the present time.
There being no further business to come before the Committee,the meeting was adjourned
at 4:30 p.m.
