Zoning and Annexation Committee

The August 25, 1997 meeting of the Zoning and Annexation Committee was called to order
by Council Member David Varner in the absence of the Chairperson and Vice-Chairperson
of the Committee at 4:35 p.m.in the Council informal meeting room.
Persons in attendance included Council Members: Aranowski, Pfeifer, Kelly, Varner,
Ujdak, Coleman, Citizen Member Doug Carpenter, Jim Voll, Dea Andrews, Don Fozo,
William Dobslaw,Don Ross and Kathleen Cekanski-Farrand.
The first item on the agenda was to review Bill No.97-59 which is a resolution requesting
the approval of a Board of Zoning Appeals action involving the property located at 3733
Locust Road.
Don Fozo, Building Commissioner, noted that the request received a favorable

Mr. William Dobslaw, the petitioner, made the presentation. He noted that he owns and
operates radio channel WHLY. FCC has changed its regulations and is requiring action to
be taken. The site involved is owned by the petitioner and is his residence. The tower is
152 feet tall and would be surrounded by ninety (90) foot trees. FAA does not require a
light on the top of this tower at this height. He has not spoken to any neighbors who are
opposed.
Council Member Ujdak,the District Council Member, noted that he had not received any
opposition to the proposal.
Council Member Coleman, noted that the special exception is necessary in light of the
special circumstances in this case,noting the large amount of acreage involved in the area.
Following discussion, Citizen Member Doug Carpender made a motion, seconded by
Council Member Pfeifer,that Bill NO. 97-59 be recommended favorably to Council. The
motion passed.
Council Member Hosinski joined the meeting at this point and chaired the duration of the
session.
The next item on the agenda was to review Bill No.58-97 which is a zoning request for the
property located at 310 and 326 South Chapin Street. Mr. Jim Voll of the Area Plan staff
showed a preliminary site plan of the area. He noted that it received favorable
recommendations from both the staff and the commission.
Mr. Don Ross,the petitioner, noted that the rezoning would permit the construction of the
Chapin Street Market. The area is now vacant. He showed an artist rendering of the
proposed building. He noted that "Save-A-Lot Food Store" and the"Chapin Street Medical
Clinic" would share the facility with the food store being 15,000 square feet and the
medical clinic being 10,000 square feet. He noted that this is a joint venture between South
Bend Heritage and Baugo Creek Realty. •

Dea Andrews noted that this project has been to the Common Council before in light of the
alley vacation and tax abatement which were needed. She noted that this project would be a
great asset to the neighborhood.
Council Member Pfeifer noted that this is part two of the redevelopment of the entire
neighborhood. She welcomed the project.
Council President Kelly spoke in favor of this positive project.
Council Member Hosinski questioned the ownership of the present site for the clinic and
was advised that it is owned by South Bend Heritage and that they would be looking for a
new tenant.
Following discussion, Council Member Pfeifer made a motion, seconded by Council
Member Varner that Bill No. 58-97 be recommended favorably to Council. The motion
passed.
The Committee then reviewed Bill No. 76-97 which is a zoning request for the property
located at the northwest corner of Ironwood and Ireland and the east side of Ironwood.
Jim Voll noted that this is an Area Plan initiated rezoning in light of the recent annexation.
He showed a map of the area in question and reported that it comes favorably
recommended to the Council.
Following discussion, Council Member Varner made a motion, seconded by Citizen
member Doug Carpender that Bill NO. 76-97 be recommended favorably to Council. The
motion passed.
There being no further business to come before the Committee,the meeting was adjourned
at 4:55 p.m.
