The August 11, 1997 meeting of the Zoning and Annexation Committee was called to order
by its Chairperson, Council Member John Hosinski at 3:30 p.m. in the Council informal
meeting room.
Persons in attendance included Council Members: Coleman, Hosinski, Varner,
Aranowski, Ujdak, Pfeifer, and Broden; Don Fozo, Don Porter, Carl Littrell, Gerald
Longerot,Phil St. Clair,Ann-Carol Simons,and Kathleen Cekanski-Farrand.
Council Member Hosinski noted that the first item on the agenda was to review Bill No.
97-44 which is a petition from the Board of Zoning Appeals for the property located at
1945 East Randolph St. Mr. Gerald Longerot the petitioner made the presentation. He
noted that he is requisition a special exception in order to permit a off-cite parking on
residential property. He showed a preliminary site plan and pictures of the area in
question.
Mr. Carl Littrell spoke in favor of the proposed exception. Mr. Don Fozo, Building
Commissioner, spoke in favor of the proposed special exception noting that the Board of
Zoning Appeals recommended the petition favorably to Council and its meeting of June 19,
1997.
Followin g discussion, Council Member Broden made a motion seconded by Council

Member Varner that Bill No. 97-44 be recommended favorably to Council.

Under miscellaneous business council Member Broden discussed Bill No. 69-97 which
was referred by the South Bend Common Council to the Area Plan Commission at its
meeting of the July 14, 1997. He noted that this bill is a zoning text amendment addressing
adult care homes in residential area. He noted that it would call for the petitioner to petition
the Board of Zoning Appeals for a special exception first. He has been approached by a
person who lives in the fourth district interested in this area.
The Council Attorney noted that state law requires a majority of the Common Council to
recommend such text amendments to zoning ordinances to the Area Plan Commission and
that such action would be in order to comply with the state law.
Following discussion, Council Member Pfeifer made a motion seconded by Council
Member Varner that Bill No. 69-97 be recommended to the Area Plan Commission on
behalf of a majority of the South Bend Common Council for text amendment review. The
motion passed.
Council Member Hosinski then brought to the committee's attention Bill No. 77-97 which
is a text amendment to the parking regulation set forth in the Zoning Ordinance. Again
similar to Council Member Broden's request, a majority of the Common Council must
petition the Area Plan Commission in order to have the Area Plan Commission take action
on the proposed measure. Council Member Hosinski noted that the proposed bill would
expand the exception to parking in the East Bank area. •

Following discussion, Council Member Broden made a motion seconded by Council
Member Pfeifer that Bill No. 77-97 be sent to the Area Plan Commission based on the fact
that a majority of the Common Council is interested in a text amendment consideration in
this area. The motion passed.
There being no further business to come before the committee,the meeting was adjourned
at 4:00 p.m.
