Zoning and Annexation Committee

The July 28, 1997 meeting of the Zoning and Annexation Committee was called to order by
its Chairperson, Council Member John Hosinski at 3:00 p.m. in the Council informal
meeting room.
Persons in attendance included Council Members: Aranowski, Pfeifer, Kelly, Broden,
Varner, Ujdak, Coleman, Hosinski; citizen member Doug Carpenter, Terry Bland,
Anthony Zappia, John Byorni, Erick Klenbauer, Kelly Killboy, Bernie Feeney, Cathy
Roemer,Kathy Dempsey,Marco Mariani,Kathy Bricker,and Kathleen Cekanski-Farrand.
Council Member Hosinski noted that the first item on the agenda was to review Resolution
No.97-54 which is a resolution to adopt a written fiscal plan and to establish a policy for a
proposed area to be annexed in the German Township commonly known as the Dan
Fuerbringer annexation. Marco Mariani made the presentation on this resolution and
Substitute Bill No. 59-97 which would annex the property into the city. He noted that the
annexation area is approximately five acres and is located north of the William Richardson
Drive. The area would become part of the Councilmanic District One. It was noted that the
cost providing overall city services to the proposed annexation area could be absorbed by
department budgets.
Following discussion, Council Member Varner made a motion seconded by Council
Member Pfeifer that Resolution No. 54-97 be recommended favorably to Council. The
motion passed.
The committee then reviewed Substitute Bill No. 41-97 which is a request to rezone on the
property that is located on 311 East Ireland Rd. Mr. John Byorni showed a preliminary
site plan to the committee. He noted that the proposed rezoning received a favorable
recommendation from both the staff and the Area Plan Commission.
Mr. Anthony Zappia the attorney for the petitioner then introduced Kelly Killboy Project
Architect for Pepboys. He noted that the property in question has been vacant since August
of '96. There would be approximately 30-35 new employees at Pepboys which is a
nationally known business. The property to the east of the proposed rezoning remonstrated
against the proposed rezoning at the Area Plan Commission.
Mr. Doug Carpenter, citizen member, stated that this is appropriate change in use for the
property.
Following further discussion, Council Member Varner made a motion seconded by citizen
member Doug Carpenter that Substitute Bill No. 41-97 be recommended favorably to

Mr.John Byorni then introduced Mr.Erick Klenbauer a new planner to the committee.
The committee then reviewed Bill No. 97-43 which is a resolution to approve a petition
from the Board of Zoning Appeals for the property located at 445 Brookfield St. Mr.
Bernie Feeney made the presentation. He stated that the petitioner is requesting a special
