COMM Wee Zeport: <br /> Public Works and Property Vacation Committee <br /> to the tommott tounstl of the tftg of 16014 gettb: <br /> The March 10, 1997 meeting of the Public Works and Property Vacation Committee was <br /> called to order by its Chairperson, Councilmember David Varner, at 3:55 p.m. in the <br /> Council informal meeting room. <br /> Persons in attendance included Councilmembers Kelly, Aranowski, Pfeifer, Broden, <br /> Varner, Ujdak, Coleman, Hosinski, and Sniadecki; John D. Wigfall, John Roxy, Ken <br /> Fedder, Joyce Boaler, John Oxian, Doug Carpenter, John Byorni, Don Porter, and <br /> Kathleen Cekanski-Farrand. <br /> The first item on the agenda was to review Bill No. 13-97 which is a proposed vacation of <br /> real property. <br /> Mr. Wigfall made the presentation. He noted that the purpose of the vacation is to <br /> eliminate illegal dumping which takes place on almost a daily basis. He stated that he and <br /> other residents will clear the alley in question and by the time they are through people just <br /> begin throwing trash and garbage in it again. <br /> Councilmember Varner noted that the proposed vacation received a favorable <br /> recommendation from the Board of Public Works as represented in the letter dated March <br /> 10, 1997. (copy attached) <br /> Following discussion, Councilmember Broden made a motion seconded by <br /> Councilmember Varner that Bill No. 13-97 be recommended favorably to Council. The <br /> motion passed. <br /> The Committee then reviewed Bill No. 16-97 which a request to vacate an alley. Mr.John <br /> Roxy made the presentation. He noted that the primary problem is an increasing number of <br /> homeless people who are using the alley and leaving refuse on the adjacent properties. He <br /> stated that the property in question is becoming an increasing area of crime and wishes to <br /> install a fence to help deter such action. <br /> Councilmember Varner noted that the request received an unfavorable recommendation <br /> from the Board of Public Works. Others noted that a question of ingress and egress was <br /> raised by one of the adjoining property owners. Mr. John Byorni noted that a staff <br /> member from the Area Plan Commission inspected the area and concluded that there may <br /> be an ingress or egress issue. It was recommended that the petitioner have a written <br /> easement agreement with the affected property owner before the the Common Council <br /> could take further action. It was further noted that such an easement agreement would have <br /> to be recorded in order to insure the rights of all affected property owners. Following <br /> discussion,the petitioner requested that his bill be continued until the March 24th meeting <br /> of the Common Council. <br /> There being no further business to come before the Committee,the meeting was adjourned <br /> at 4:12 p.m. <br /> • <br />
