Public Works and Property Vacation Committee

The January 8, 1996 meeting of the Public Works and Property Vacation Committee was
called to order by its Chairperson, Council Member Dr.David Varner at 4:45 P.M. in the
Council informal meeting room.
Persons in attendance included Council Members: Varner, Luecke, Kelly, Zakrzewski,
Broden, Washington, Hosinski, Coleman, and Pfeifer; John Oxian, Mr. William
Wasienko, Gene Oakley, T. Brooks Bradamas, Don Porter, and Kathleen Cekanski-
Farrand.
Council Member Varner began the meeting by introducing members of his Committee
which include himself as Chairperson, Council Member Zakrzew ski as Vice Chairperson,
Council Member Cleo Washington and Council Member Charlotte Pfeifer.
Council Member Varner noted that the first item on the agenda was to review substitute Bill
No. 87-95 which is a proposed vacation of public property.He noted that he has reviewed
all of the recommendations for the various agencies of the City and that the Board of Public
Works has made a favorable recommendation with regard to the vacation.
Mr.William Wasienko the attorney for the petitioner then made the presentation.He noted
that the substitute Bill was necessary in order to provide proper notification to the property
owner who resided in New York. Mr. Wasienko noted that the primary purpose for the
proposed vacation would be to reduce the amount of vehicle traffic, to reduce the noise
from vehicles and to reduce damage currently being caused by traffic and loitering in the
area.
Council Member Varner voiced concern with regard to the report from the Division of
Engineering which noted that if the alleys are vacated that there would be no way for the
property located at 1123 South Michigan Street to have access to the rear of the property for
trash pick-up. Council Member Hosinski noted that he had received a call from Mr.Joseph
Gorny however was unable to recontact him. Council Member Hosinski then left the
meeting to make such a contact to see if it was related to the proposed vacation.
Council Member Pfeifer voiced concern as to whether all of the property owners received
proper notice. Mr. Wasienko noted that he delivered all of the envelopes and notices as
required to the City Clerk's office.
Upon his return, Council Member Hosinski noted that he was unsuccessful in contacting
Mr. Gorny however he did note that Mr. Gorny was one of the property owners who
signed in favor of the proposed vacation.
Council Member Coleman then left the meeting to contact the Engineering Department with
regard to the concerns raised by Council Member Varner. After discussion with the
Engineering Department it was noted that the issue of whether the property is contiguous to
the proposed vacation was properly satisfied. The Council Attorney summarized the
provisions of the applicable state law found in Indiana Code Section 36-7-3-12.

Following further discussion, Council Member Zakrzewski made a motion, seconded by
Council Member Washington that substitute Bill No. 87-95 be recommended favorably to
Council. The motion passed by a 3 to 1 vote with Council Member Pheifer in the minority.
Council Member Pheifer noted that she is concerned with regard to the notice issue and
.stated that she believes that the Council should be especially sensitive to neighborhood type
issues and until the notice issue is confirmed that all property owners were properly
notified, that she could not vote in favor of the proposed vacation.
Council President Kelly noted that Mr.T. Brooks Bradamas had contacted him earlier and
requested time to address the Council. Under "unfinished business" Mr. Bradamas was
given the opportunity to provide information on the proposed County Jail Project.
There being no further business to come before the Committee, the meeting was
adjourned at 5:55 P.M.
