Re: PRELIMINARY MBE/WBE PARTICIPATION REPORT FOR CALENDAR YEAR 2011
Section 14.5-11 of Ordinance No. 10081-11 (Substitute Bill No.86-10, as amended) requires that the MBE/WBE
Utilization Board, in conjunction with the Diversity Compliance Officer,file a report(a MBE/WBE Participation Report)
with the Office of the City Clerk by the third Wednesday of January,which this year is January 18th
This memorandum is intended to report on the progress of the recently formed MBE/WBE Utilization Board (hereinafter
referred to as"MWUB") and,for this year only,to substitute for the aforementioned MBE/WBE Participation Report.
The reason: the MWUB has been in place for only three months prior to the January 18th reporting deadline date, a
Diversity Compliance Officer is not now in place,and our activities and efforts to date have centered around
organization formation and review of the Ordinance. However,following the hiring of a Diversity Compliance Officer,
we commit to work with the Diversity Compliance Office to submit an "interim-year" MBE/WBE Participation Report for
2012.
The Participation Report required by Ordinance No. 10081-11 is to provide data on all city contracts for the prior
calendar year, as outlined below:
1. Summary efforts taken to create and promote economic growth opportunities for MBEs/WBEs;
2. List of certified local MBEs utilized by the city;
3. List of certified regional MBEs utilized by the city;
4. List of certified local WBEs utilized by the city;
5. List of certified regional WBEs utilized by the city;
6. Total dollar amount of city contracts awarded to certified local MBEs;
7. Total dollar amount of city contracts awarded to certified local WBEs;

8. Percentage of all city contracts awarded to certified local MBEs;
9. Percentage of all city contracts awarded to certified local WBEs;

10. Number of emergency contracts awarded by the city;
11. Number of MBE/WBE Program Waivers issued listed by type of occupational category;
12. Summary of data on minority groups who participated;
13. Summary of Section 3 Work Force utilized and Training Needs Offered and Addressed by occupational
categories;
14. Samples of MBE/WBE/Section 3 Contact/Solicitation and Commitments for contract awards which exceeded
$25,000;
15. Samples and Procedures for Invitations for Bids(IFB)or Requests for Proposals(RFP) Evaluation including
Checklists utilized for each;
16. Process Used for Evaluation and Determination of the lowest, responsible and responsive bids;
17. Process Used for Evaluation and Determination of non-responsible and/or non-responsive bids; and
18. Other relevant information.
BACKGROUND AND CURRENT STATUS:
Ordinance No. 10081-11 was passed into law by the City of South Bend's Common Council on April 11, 2011,effective
July 1, 2011. The nine members of the MWUB were appointed by October 19,2011;they are:
• Franklin Breckenridge
• Sam Centellas
• Thomas Coley(Board Vice President)
• Anthony Fitts (Board President) "
• Kareemah Fowler(Board Secretary)
• Gary Gilot--as the City's Public Works Director
• Carrie Kosac
• Jinny Longbrake
• Jeff Rea
At this time,the Public Works Director's seat on the board is open, pending appointment of a new director. Mr. Gilot
has offered to remain involved with the MWUB as a Citizen Volunteer;we heartly welcome Mr. Gilot's continued
involvement and assistance.
Our first Board meeting was held on November 10,2011. Since then,we have held meetings on December 5, 2011,
January 4,2012, and January 12, 2012 which have focused on selection of officers; organizational planning; review of
existing City-generated reports on MBE/WBE statistics; review of policies and practices of similar MWUBs in other cities
across the state; establishment of liaison relationships with Common Council and City staff; and an initial review and
question session with members of the City's legal staff about specific sections of Ordinance No. 10081-11. Many of
these tasks are ongoing, but a few of the important responsibilities of the MWUB to be accomplished over the next
several months include:

• hiring of a "Diversity Compliance Officer", per Section 14.5-2(i),which will require that the MWUB establish
strategic priorities and goals for that position;generate a corresponding job description; interview potential
candidates;and make a hiring recommendation for Common Council's approval.
• developing a plan for the increased utilization of MBEs and WBEs(the MBE/WBE Utilization Plan for the City
of South Bend),which plan "...shall also promote local MBE/WBE business development in the
community....", per Section 14.5-3(e)(3)of the ordinance.
To that end,the MWUB will continue to work diligently and meet frequently to satisfy those critical objectives,and
report on our progress.
