Zoning and Annexation Committee
to the £ommou Council of the E ttg of South Stub:
The June 10, 1996 of the Zoning and Annexation Committee was called to order by its
Chairperson, Council Member Tom Zakrzewski, at 4:05 P.M. in the Council informal
meeting room.
Persons in attendance included Council Members:Luecke,Zakrzewski,Coleman,Pfeifer,
Varner, Hosinski, and Broden; Doug Carpenter, Malcolm Tuesley, Larry Bremen, Don
Fozo,John Byorni,Don Porter,and Kathleen Cekanski-Farrand.
The first item on the agenda was to review substitute Bill No. 33-96 which would amend
the Zoning Chapter of the South Bend Municipal Code to include arcades as a use,which
would be permissible in community centers and regional centers within"C-2"districts.
Mr. John Byorni noted that the Bill received favorable recommendations from both the
Area Plan Commission and the Staff.
Mr. Don Fozo made the presentation. Mr. Fozo noted that the current"C-2" zoning does
not permit an arcade within a community center.He also noted that an interpretation clause
was added that if there is uncertainty with regard to a classification that the Board of Zoning
Appeals would have the right to interpret.
Council Member Varner spoke with Randy Zimmerman of Scottsdale Mall and they are
very excited about the new developments that would be coming to the Mall.
Following further discussion, Council Member Luecke made a motion, seconded by
Council Member Varner that substitute Bill No. 33-96 be recommended favorably to
Council.The motion passed.
The Committee then reviewed Resolution No.96-50 which approve a petition of the South
Bend Board of Zoning Appeals for the property located at 2002 Mishawaka Ave. Mr.
Malcolm Tuesley the attorney for the petitioner, Dr. Robert L. Proudfit made the
presentation. The request would permit off-site parking on residential lot 4 owned by Dr.
Proudfit. The Board of Zoning Appeals made a favorable recommendation to the Common
Council.
Following discussion, Citizen Member Doug Carpenter made a motion, seconded by
Council Member Varner that Resolution No.96-50 be recommended favorably to Council.
The motion passed.
There being no further business to come before the Committee the meeting was adjourned
at 4:15 P.M.
