HomeMy WebLinkAbout01-22-96 Zoning & Annexation eommftt*s Z port: Zoning and Annexation Committees �o tbs Common Council of t0; Cftt of fout1 Ssnb: The January 22, 1996 of the Zoning and Annexation Committee was called to order by its Chairperson, Council Member Tom Zakrzewski, at 4:00 P.M. in the Council informal meeting room. Persons in attendance included Council Members Luecke,Washington,Kelly,Zakrzewski, Coleman, Pfeifer, Varner, and Broden; John Byomi, Donna Gerring, Richard Morgan, Jim Voll, Jenny Pitts Manier, Stere Russo, Betsy Herroman, Tasia Jaques, Don Porter, and Kathleen Cekanski-Farrand. The first item on the agenda was to review Bill No.62-95 which is a zoning request for the property located at 710 East Wayne Street. Mr. John Byorni showed a preliminary site plan of the proposal. He noted that it approximately 9000 sq. ft. and received a favorable recommendation from both the Area Plan Commission and the Staff. In light of the fact that a presenter was not present, the Committee decided to hear this matter after the next item on the agenda. The Committee then reviewed substitute Bill No. 75-95 which is a zoning request for the property located at 828 Jefferson Blvd. Mr. John Byorni showed a preliminary site plan of the area and noted that it received a favorable recommendation from both the Area Plan Commission as well as the Staff. In response to a question raised by Council Member Varner, Mr. Byorni noted that the Alcoholism Council did send a letter voicing concern over parking. The letter also voiced concern with regard to screening. Mr. Steve Russo the planner for the petitioner then made the presentation. He noted that the proposed building would have two and a half stories with 7 offices each on the top two floors. There would be a total of 8,640 sq. ft. in the project. The City Board of Zoning Appeals granted a variance with regard to the required 28 parking spaces reducing this sum to 17 parking spaces on site. There would also be screening along Jefferson. Mr. Russo noted that the first floor would not be used for anything except storage until additional parking could be reached. Council Member Broden voiced concern with regard to the screening between the sidewalk and Jefferson Blvd. and also with regard to the proposed parking. Mr. Byorni noted that in a E Height and area designation that there is 0 frontage setback requirements. Under the public portion Donna Gerring spoke in opposition to the proposed rezoning. She stated the she lives at 208 South St.Peter and that her family has lived in the area for more than 50 years. She stated that she has philosophical problems since this is near East Historical District. She stated that there are problems with the Parkview atrium parking and traffic and believes that additional parking and traffic would be created by such proposed rezoning. • Committee Report Zoning and Annexation January 22, 1996 Page 2 In the Council portion, Council Member Coleman questioned what the zoning of the Alcoholism Council building was. He was informed it was B zoning and that Weiss Homes also was B zoning as a legal non-conforming use. Council Member Coleman stated that he has concern and objects to parking in the front yard. Council Member Luecke also voiced concern with regard to allowing parking in the front lot and believed that there may be a domino affect if this was allowed. r Kathleen Cekanski-Farrand then noted that she has a specific conflict of interest as being Council Attorney however also a property owner in the affected area with property being located at 914 East Jefferson being owned by herself and Greg Blanford. She stated that when they came before the City Council last year for a C-1 zoning similar to what is being requested this evening that she does not object to that zoning classification but does object to the E Height and Area classification in light of the parking proposal in the front yard. Mr. Byorni stated that if their is a change in ownership that other uses would be allowed. He stated that because the proposal exceeds the 0 office designation of 5, 000 sq. ft. maximum that that would not be a proper zoning classification. Council Member Pfeifer questioned whether the petitioner had contacted the Alcoholism Council with a regard to a contractual arrangement with regard to parking. Mr. Russo stated that they had not. If fact he stated that the Alcoholism Council is concerned that Weiss Homes would be utilizing their parking lot informally. In response to a question raised by Council Member Coleman it was noted that Dr. Macri demolished a structure in light of the parking concern in the area for his building. Council Member Coleman stated that he is in favor of the project however is against any parking in the front yard. Council Member Washington also voiced concern and believes that a compromise is necessary. Council Member Coleman volunteered to work with Mr.Russo. Following discussion with regard to the time table involved, Mr. Russo requested that the matter be tabled until the Council meeting of February 26, 1996 to allow time to work out a possible alternative to the parking situation. The Committee then returned to the presentation of Bill No. 62-95 the zoning request for the property located at 710 East Wayne Street. Mr. Richard Morgan the attorney for the petitioner made the presentation.He stated that the proposal would be for an 18,000 sq,ft. class A office building which would cost between 2 and 2 and a half million dollars. Following discussion, Council Member Luecke made a motion, seconded by Council Member Varner that Bill No. 62-95 be recommended favorably to Council. The motion passed. Under miscellaneous business Mr. John Byorni then introduced that new Staff Planner of the Area Plan,James Voll to the Committee. • « _ Committee Report Zoning and Annexation January 22, 1996 Page 3 f l Mr.Byomi also showed the new zoning maps of two different scales to the Committee.He stated that once the maps are approved that they would be available in the Area Plan Office as well as the Building Department. In response to a question raised by Council Member Varner it was noted that ledgers would be placed on each of the maps. It is also being contemplated that a CD ROM would be available at some point in the future. Mr. Byorni also stated that the Staff of the Area Plan Commission is working on a new subdivision ordinance which will specifically address the concerns addressing legal splits.
