Board Member Al Kirsits was not present. The meeting was held in Classroom 1 at the Luther J. Taylor, Sr. Fire Training Center, 710 East Sample Street, South Bend, Indiana, for the purposes specified in I.C. 5-14-1.5-6.1(b)(2)(A) for discussion of strategy with respect to collective bargaining and I.C. 5-14-1.5-6.1(b)(6)(A) to receive information concerning an individual’s alleged misconduct. REGULAR MEETING September 21, 2022 The Board of Public Safety met in the Regular Meeting at 9:18 a.m. on Wednesday, September 21, 2022, with Board President Daniel Jones, and Board Members Darryl Heller and Lee Ross were present. Also present were Police Chief Scott Ruszkowski, Fire Chief Carl Buchanon, and Attorneys Danielle Weiss, Kylie Connell, Christine Shakour (virtual) and Board Clerk Theresa Heffner were also present. The meeting was held in Classroom 2-3 at the Luther J. Taylor, Sr. Fire Training Center, 710 East Sample St., South Bend, Indiana and virtually via Microsoft Teams at the following link: https://tinyurl.com/BPS-09212022 Attorney Weiss asked that everyone mute their microphone when not speaking and reminded attendees that comments from the public should be saved for the Privilege of the Floor portion of the meeting. Attorney Weiss then read through the agenda to note any additions or corrections. Attorney Weiss welcomed the public, called roll, and confirmed the presence of all Board Members. A.APPROVE MINUTES OF PREVIOUS MEETINGSUpon a motion by Darryl Heller, seconded by Lee Ross and carried by roll call, the Boardapproved the Minutes of the July 20, 2022 regular meeting. Upon a motion by Lee Ross, seconded by Dan Jones and carried by roll call, the Boardapproved the Minutes of the August 25, 2022 special meeting minutes as presented. DarrylHeller was not present at the August 25, 2022 special meeting so he abstained from voting. B.FIRE DEPARTMENT 1.APPROVE CAPTAIN’S PROMOTION RANK LISTSamuel EllingerBrian Patterson Joshua RichhartTony SchelskeJustin LachmundTroy WhitselTyler King Justin Riehm REGULAR MEETING SEPTEMBER 21, 2022 65 Steve Gervais Chief Buchanon submitted a letter requesting the approval of the above firefighters as having completed and received the top scores during the recently completed captain’s promotion process. The firefighters were presented to the Board of Public Safety Members in accordance with their ranking as Captain positions become available. Chief stated this list is good for two years or until exhausted. Upon a motion by Darryl Heller, seconded by Lee Ross and followed by a roll call, the Board approved the Captain’s Promotion Rank List. 2.APPROVE PROMOTION’S TO CAPTAIN IN SPECIAL ASSIGNMENTSamuel EllingerBrian PattersonJoshua RichhartTony Schelske Justin Lachmund Chief Buchanon submitted a letter of recommendation for promotion of Captains in SpecialAssignment for the above firefighters. Chief Buchanon stated the SBFD currently has avacancy for a Captaincy position and stated in accordance with the promotion policy established by the SBFD and IAFF local #362, eligible firefighters were ranked to fill openpositions as a Captain in Special Assignments (CISA) for a one (1) year probationary period.Chief Buchanon noted during the probationary year the firefighters will continue to receive aminimum of four (4) performance evaluations. After successfully completing allrequirements during the probationary year, the Fire Chief will make a recommendation for permanent promotion to the rank of Captain. Assistant Fire Chief Brandon Roark gave abrief bio for each individual before they were pinned by family members. Upon a motion by Darryl Heller, seconded by Lee Ross and followed by a roll call, thepromotions to Captain in Special Assignment have been approved effective September 21, 2022. 3.RECEIVE MONTHLY STATISTICAL ANALYSIS REPORT AUGUST 2022Chief Carl Buchanon submitted the monthly statistical analysis report for August 2022.Chief Buchanon pointed out the dramatic increase in property damage estimates from August 2021 compared to August 2022. He added that the Department has been working oninspections and re-inspections to get businesses open after the Covid-19 pandemic. He notedthat escalation in EMS calls could be due to Covid-19 as well as the Opioid epidemic C.POLICE DEPARTMENT REGULAR MEETING SEPTEMBER 21, 2022 66 1.APPROVE 2022 HALLOWEEN TRICK OR TREAT HOURS Chief Ruszkowski submitted a letter to the Board for the SBPD Halloween Trick or Treathours to be held on Sunday, October 31, 2022, from 5:00p.m. to 7:00p.m. Chief Ruszkowskialso noted that the annual Cops and Goblins event will be held October 24, 2022 from5:00p.m. to 7:30p.m. at Four Winds Field. Upon a motion by Darryl Heller, seconded by Lee Ross, and followed by a roll call, theHalloween Trick or Treat hours were approved. 2.ACCEPT LETTER OF RESIGNATION TIMOTHY BARBERChief Scott Ruszkowski submitted a Letter of Resignation from Timothy Barber effective September 15, 2022.President Jones accepted the Resignation on behalf of the Board. 3. RECEIVE LEXIPOL POLICIES334 - Public Safety Video Surveillance System343 - Facial Recognition TechnologyAttorney Kylie Connell said that the IT and Public Safety committee are working on acamera expansion program including a real-time crime center. She asked the Board receivethe policy updates to look them over for voting at a future BPS meeting. There will also becommunity action groups related to these topics on October 4, 2022 at 6:30p.m. – 7:30p.m. at the O’Brien Fitness Center to further discuss the technology upgrades and correspondingpolicies. Chief Ruszkowski informed the Board the information would be posted to theirwebsite and a link for the public to provide input would be posted as well. President Jones received the Lexipol Policy updates on behalf of the Board. 4.FILE MONTHLY STATISTICAL ANALYSIS REPORT FOR AUGUST 2022Chief Scott Ruszkowski submitted the monthly statistical analysis report for August 2022.He noted a twelve percent (12%) reduction in overall Part-One Offenses; however, therewere one-hundred (100) people shot in August in South Bend with seventeen (17) of those being fatalities.President Jones received the Monthly Statistical Analysis Report for August 2022 on behalfof the Board. REGULAR MEETING SEPTEMBER 21, 2022 67 D.PRIVILEGE OF THE FLOORAttorney Weiss reminded the public to use the hand-raising function of Microsoft Teams toindicate their desire to speak during Privilege of the Floor. She reminded attendees that theywould be allotted three (3) minutes to speak. There were no individuals in person or online that indicated they wished to be heard.
