The accommodation requested requires the City to review whether the request is reasonable and a genuine improvement over a disabled persons options without the accommodation. The City does not believe it to be reasonable to create an accommodation that requires you to put your life at risk by crossing the middle of a busy Portage Avenue as well as a potential traffic infraction as well, especially if the applicant’s ability to avoid danger by running or moving swiftly is also greatly impaired. Therefore, the Board of Public Works reaffirms its determination that the parking pad at the back of the property will provide better access than the high traffic access on Portage Ave. We do encourage you to contact the South Bend Human Rights Commission in order to inquire about potential lighting improvements in which your landlord can institute which may make the alley and adjacent parking pad better lit in the evening/night hours.
