Mayor BILL NO. 47-22 ORDINANCE NO. 10881-22 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING TIPPING AND LOADING CHARGES FOR YARD WASTE CUSTOMER WITHIN TWO SECTIONS OF CHAPTER 16, ARTICLE 4 OF THE SOUTH BEND MUNICIPAL CODE STATEMENT OF PURPOSE AND INTENT The City's Organic Resources facility collects and processes yard waste materials from area residents. This service is separate from the City's yard waste program where residents can sign up to receive their own yard waste bin which is picked up weekly. Material taken to the Organic Resources facility is processed and converted into mulch and compost for area residents to use at no cost if they are self-loading. The City currently charges the same tipping fee for customers both inside and outside the corporate limits of South Bend to bring in yard waste material. A loading fee is also charged if City staff use their equipment to load mulch and compost into customers vehicles. This ordinance increases the tipping fees for customers who live outside the corporate limits of South Bend to dispose of yard waste material. Loading charges for mulch and compost are also adjusted for all customers. These changes are meant to better reflect the actual operational costs of services provided to customers. This ordinance is necessary for the effective, efficient operation of the City's Organic Resources facility and is in the best interest of the City and its citizens. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA as follows: SECTION I: The South Bend Municipal Code at Section 16-27 and Section 16-29 of Article 4 is hereby amended to read in its entirety as follows: Sec. 16-27.—Policy regarding disposal of yard waste. It is hereby stated as the policy and law of the City of South Bend that all yard waste as defined herein generated by or emanating from the City, whether from residential, commercial, industrial, institutional or governmental sources, shall not be landfilled. Such yard waste, whether collected by the City, commercial lawn services, tree services or private carriers, shall be disposed of at the City's Organic Resource Facility for recycling; provided, however, that nothing herein shall prevent any individual or company from otherwise recycling yard waste in a manner approved by the Director of the Department of Public Works. : . . . - - . --•. • .. . No. 10270-13, § III, 11-11-13) 1 Sec. 16-29. - Tipping charges; purchase of recycled yard waste products; exemptions. a) Tipping charges for disposal of yard waste at the Organic Resource Facility are set at three dollars and sixty-five cents($3.65)per cubic yard for customers living within the city limits of South Bend and eleven dollars ($11.00)per cubic yard for customers living outside the city limits of South Bend. b) Compost, wood chips and other recycled yard waste products may be obtained from the Organic Resource Facility at no charge if the person loads the material themself. hin el If employees at the City or its agents load such material(s) the cost for materials up to four (4) cubic yards shall be five dollars ($5.00) excluding sales tax, per cubic yard. For loading of more than four (4) cubic yards the loading fee shall be nine dollars ($9.00) excluding sales tax, per cubic yard for all yards, including the first four(4) cubic yards. • - - . . . .. Delivery to a specific site may also be provided for loads between a minimum of (twenty) 20 cubic yards and a maximum of twenty-five (25) cubic yards at a separate delivery charge of fifteen dollars ($15.00) four dollars ($1 00) per cubic yard, excluding sales tax. c) The Board of Public Works,pursuant to the powers granted by IC 36-9-30, may from time to time adjust and change the tipping charges at the Organic Resource Facility and the charges for the purchase of recycled yard waste products set out above. Such changes and adjustments may be made only after a public hearing and shall be based upon the actual cost of processing the yard waste, producing the recycled product, and operating the Organic Resource Facility, including the establishment of a reasonable reserve for capital improvements. d) The following programs and departments of the City shall be exempt from payment of the tipping charges set out above: Operation Relief • Solid Waste/Yard Waste Program Park Department e) All City departments and programs shall be exempt from the payment of charges for recycled yard waste products. This Ordinance shall be in full force and effect from and after its passage by the Common Council, approval by the Mayor, and any publication required by law, but no earlier than January 1, 2023.
