At its September 27, 2022 meeting, the Board of Public Works approved the Final
Change Order for this project, be decreased by $20,757.75 with an additional one thousand five
hundred & eighty-five (1,585) days. The final contract amount is $208,047.25 with a new
completion date of September 5, 2022.
In addition, the Project Completion Affidavit for this project was approved in the amount
of $208,047.25. Copies of the Change Order and Project Completion Affidavit are enclosed for
your records.

This project has been ongoing for several years now. As you know, the project was initially bid on
December 19, 2017. The scope of work for the original bid called for the lining of an existing 30”
clay sewer and installation of a 24” HDPE bypass line to be installed underneath the access for
Indiana Toll Road Plaza 77. The completion date for the project was May 4, 2018.
Ms. Sue Ellen Doudrick, assistant city engineer at the time, was the project manager assigned to this
project. In talking with Ms. Doudrick post bid, she expressed concerns with regards to health and
safety in the CIPP lining process based on a “recent” published report. Talks turned to upsizing the
initial 24” bypass line to a 30” sewer line and abandoning the existing 30” clay line in place.
Upon her request, Selge Construction Co., Inc. (SELGE) provided a proposal for upsizing the
proposed 24” sewer line and abandoning the existing 30” clay sewer with flowable fill. This proposal
was accepted by Ms. Doudrick and the City of South Bend. Regardless of the change in pipe size, a
large area in which to stage, fuse, and install the HDPE pipe was needed. A long, gradual access
ramp was required to make it possible to successfully pull the large diameter HDPE into the ground.
It was agreed by all parties that the fields adjacent to the west side of the toll road access road was
the best location to excavate this ramp as the east side would require asphalt pavement removal. The
field is owned by the Sisters of Holy Cross (THE SISTERS).
Ms. Doudrick contacted Danch, Harner and Associates (DANCH) to draw up the temporary
easement and paperwork needed for the sewer installation. SELGE worked with DANCH on the
size of area needed. The easement paperwork took until the end of May 2018 to complete. South
Bend released SELGE of the May 4th completion date until the easement and change order process
were complete. Once the easement paperwork was complete, Ms. Doudrick approached THE
SISTERS about requiring the easement.
The change order to upsize the 30” sewer was approved on June 12, 2018, however, the negotiation
with the Sisters of the Holy Cross went back and forth. One concern of THE SISTERS was the
inherent crop damage since we were in the middle of the growing season. They wanted to push
construction until after the crops had been harvested. There were other stipulations posed by THE
SISTERS that the City of South Bend did not find agreeable. The easement negotiations came to a
stalemate after several months of negotiation.
This project was placed on hold until an agreement was reached. Without this agreement, the sewer
could not be installed. Ms. Doudrick held this project for several years without any movement or
agreement with THE SISTERS. SELGE inquired several times of Ms. Doudrick as to the status of
the project and if it was still going to be constructed, but to no avail.
It was not until you were handed the project in October 2021, Toy, that the project started gaining
traction again. You asked Ms. Doudrick as to whether there were any other options and if she had
any contact with Brian Cherry at the Indiana Toll Road (ITR) about the possibility of an above
ground bypass. You spoke with him regarding our dilemma and viable options. Mr. Cherry was very
cooperative and agreed to let the City of South Bend construct an above ground bypass. He
forwarded you all the procedures and necessary permits, which you forwarded onto me.
It was determined at that time the best course of action would be to just line the 30” sewer and walk
away from the idea of installing a new sewer line. Based upon the time of year, it was not feasible to
complete the project in 2021 as we needed to requote the CIPP lining and weather constraints with
above ground bypassing.
In early 2022, we had our revised lining numbers and determined that we could still construct the
project within our old 2018 revised contract amount. At that point we filed the necessary permits
with ITR and signed a contract with Inland Waters to line the sewer. They were scheduled and set to
mobilize for the pre-lining video inspection. Upon lining submittal review by Mr. Josh Ehmer, it was
determined that the 2017 lining specification was outdated. SELGE then signed a contract with
Aegion (Insituform) for CIPP lining the 30” sewer. This delayed us 2 months by the time the
paperwork was completed and through their legal department.
With the paperwork finalized, we were able to finally schedule the work. We mobilized the week of
July 25, 2022, to install the sewer bypass and have Aegion perform their pre-lining video of the
sewer. Once the video was complete, Aegion was able to order the 30” sewer liner. The liner was
delivered a month later. We remobilized the week of August 29, 2022, to reinstall the sewer bypass
and complete the CIPP lining. The project was completed in its entirety by August 31, 2022.
