Zoning and Annexation Committee

The July 25, 1994,meeting of the Zoning and Annexation Committee was called to
order by its Chairperson, Council Member Lee Slavinskas at 3:47 P.M.in the Council
informal meeting room.
Persons in attendance included Council Members: Luecke, Washington, Kelly, ,
Slavinskas, Zakrzewski, Coleman, Duda, Ladewski and Puzzello; Ed Fisher, Don Fozzo,
John Byorni,Don Porter, and Kathleen Cekanski-Farrand.
Council Member Slavinskas noted that the first item on the agenda was to review
Bill No. 51-94 which is a zoning request for the property located at 1129 Hickory Road.
Mr. Byorni gave the staff report. He noted that both the staff and the Area Plan
Commission send this proposed rezoning with a favorable recommendation.
Mr. Ed Fisher a land surveyor spoke on behalf of the petitioner. He showed a Site
Plan to the committee. The rezoning involves 80, 800 sq. ft. to be rezoned for a Physical
Therapy office. The current building would be moved and not torn down.
Following discussion, Council Member Duda made a motion, seconded by Council
Member Washington that Bill No. 51-94 be recommended favorably to Council. The
motion passed.
The next item on the agenda was to review substitute Bill No. 58-94 which would
amend Chapter 21 of the South Bend Municipal Code addressing zoning.
Mr. John Byorni stated that this is a Area Plan initiated ordnance. He noted that it
was discussed at the last Common Council meeting but because of concerns raised by the
Council over accessory buildings it was continued.
He noted that there had been meetings with Council Member Slavinskas and
concerned individuals which resulted in former section being deleted from the Bill. It was
noted that the amended version now deals with parking lot regulations, off street parking
and loading and storage areas, parking in front yards, and noncommercial buildings and
uses.
Mr. Fozzo provided further explanation for the proposed changes. He sited L-
shaped houses as a problem which are in technical violation of current zoning regulations.
Mr. Byorni also raised the issue when houses are burnt whether they should be
required to go through rezonings especially where they are located in different zoning
classifications. Mr. Fozzo noted that these are difficult situations.He added that St. Joseph
County provides that when a home is destroyed by fire or natural causes they are allowed
to rebuild.
Following discussion there was an overall consensus that residential units be
permitted to rebuild when destroyed by fire or natural causes.

Following discussion,Council Member Duda made a motion seconded by Council
Member Zakrzewski,that substitute Bill No. 58-94 be recommended favorably to Council.
The motion passed.
There being a no further business to come before the Committee, the meeting was
adjourned at 4:10 p.m.
