The September 26, 1994 meeting of the Community and Economic Development
Committee was called to order by its Chairperson, Council Member Roland Kelly at 4:55
p.m. in the Council informal meeting room.
Persons in attendance included Council Members Luecke, Kelly, Puzzello,
Washington, Duda, Slavinskas, Coleman, Zakrzewski, and Ladewski; Mike Beitzinger,
William Eagen,John Broden,David Merkin,Dennise Sullivan, Carry Levin, Carl Littrell,
Don Porter, and Kathleen Cekanski-Farrand
First item on the agenda was to review Resolution No. 94-88 which is a Tax
Abatement request for the property located at 1145-1305 Prairie Ave.Mr. Mike Beitzinger
reviewed the report dated July 5, 1994 (copy attached). It noted that the project calls for
the purchase and installation of two Hydraulic Pedestal Cranes and a wire line. Total
project costs are estimated at$1,280,000.00, and would create 16 new permanent jobs.
The Council Attorney then provided a hand-out to each of the Committee Members
which contained a copy of the state law authorizing the Council to establish general
standards and reasonable conditions with regard to new manufacturing equipment. Also
attached was ro osed language for a new section 9 with current section 10 of the

Resolution to be amended prepared by the City Legal Department.
Mr John Broden of the City Attorney's office then reviewed the background
information and the need for such an amendment to the Resolution.
Mr. David Merkin, the Attorney for the petitioner noted that the law suit regarding
noise levels by the City was dismissed. He stated that the decibels levels requested are an
impossible standard. Mr. Carry Levin then spoke before the Committee. He stated that
despite the request from the Common Council at the last Committee hearing and Council
meeting, that he did not have any information available with regard to noise levels of the
new equipment in question. He stated however that he is seeking information from a
company in France.
Council Member Slavinskas questioned whether the cranes would be replacing
current ones and was advised that they were. It was noted that they are currently using
diesel cranes which would be replaced by Hydraulic Cranes. Mr. Levin also noted in
response to Council Member Slavinskas that they could further insulate the pedestals of the
cranes.
Council Member Zakrzewski stated that he is concerned in light of the fact that the
requested noise levels of the new manufacturing equipment had not be provided. He stated
that there is absolutely no proof before this Council with regard to what the noise levels
would be. He noted that residents can hear noise as far away as three blocks and they
continue to be awakened between the hours of 2:00 to 4:00 A.M. He further stated that he
wants something built into the Resolution other than the judicial system.
Council Member Washington voiced a potential equal protection argument.

Council Member Slavinskas stated that he believes that the hydraulic units should
be quieter than those of diesel units based on his work experience.

Council Member Luecke asked whether the petitioner would be agreeable to comply
1 1 with the City Noise Ordinance and the petitioner stated that they would not agree to the
I. residential levels.
Council Member Colemen stated that as part of the Tax Abatement process that
petitioners can be held to higher standards such as enhanced screening. He stated that the
problem becomes a higher standard verses more difficulty to operate within the City.
Council Member Duda stated that the continuous running and noise has been

reported to her and that she has had first hand knowledge of sleep being disrupted around
�' the hours of 2:30 in the morning.

j'A Following further discussion Council Member Slavinskas, made a motion,
seconded by Council Member Luecke, that Resolution No. 94-88 be recommended
favorable to Council as presented without amendment. The motion passed.
