HomeMy WebLinkAbout12-19-94 Zoning & Annexation tommitttt Ztport: Zoning and Annexation Committee 'go tljt tommott toutttil Of tjt City of Xout *40: • The December 19, 1994 meeting of the Zoning and Annexation Committee was called to order by it Chairperson, Council Member Lee Slavinskas at 4:50 P.M. in the Council informal meeting room. Persons in attendance included Council Members Luecke, Washington, Kelly, Puzzello, Slavinskas, Zakrzewski, Coleman, Duda, and Ladewski; Jenny Pitts Miner, John Bynori, Eugenea Schwartz, Chief Ron Marciniak, Mr. Herman Kruggel, Mr. Greg Blanford, James, Joe Amaral, Ann Kolota, Paul Bolger, Mrs. Bolger, Mr. Holland, Berry Mangus,Don Porter, Karen Kmiemic,David DuVall, and Kathleen Cekanski-Farrand. The first item on the agenda was to review substitute Bill No. 97-94 which is a rezoning request for the property located at 320 South Michigan. Mr. Bynori noted that the request is to an"0"office and in light of the upcoming house move that the reclassification is necessary for the petitioner to continue to use the premise both as a residence and as an insurance office. Ann Kolata stated that the Redevelopment Department supports the petition. Mr Masters made the formal presentation on behalf of the petitioner. Following j discussion, Council Member Washington made a motion, seconded by Council Member Zakrzewski that substitute Bill No. 97-94 be recommended favorably to Council. The motion passed. t F The Council then reviewed Bill No. 98-94 which is a rezoning request for the property located at 914 East Jefferson Blvd. The Council Attorney noted that she had been advised by the City Attorney's office that she does have a conflict of interest since she is one of the proposed owners of the building in question. Mr. Bynori noted that "0" office would be appropriate however in light of the numerous variances required, that the staff is recommended "C-1" zoning classification as being preferable.Mr Greg Blanford made the presentation. He noted that there would be 5 attorneys in the building along with 6 to 8 staff persons. He further introduced Mr. Kruggle the current owner of the building, and noted that Mr. Blanford and the Council Attorney are proposed purchasers of the building in question. He then showed a preliminary site plan to the Committee along with a picture of the structure. Council Member Puzzello noted that this would be within her district and that she is in favor of the proposed rezoning. Following discussion, Council Member Washington made a motion, seconded by Council Member Zakrzewski, that Bill No. 98-94 be recommended favorably to Council. The motion passed. The Committee then reviewed Bill No. 99-94 which is a rezoning request for the property located at 114 N. Francis. Mr. Bynori noted that it received a favorable recommendation from the Area Plan Staff and Commission. Mr. Amaral made the presentation on behalf of the Michiana Hematology Oncology. He stated that they will cooperate with the Historic Preservation Commission however they will not pay for any move of structures. He noted that there are 40 employees and that this would create a safer parking environment. Mr. Paul Bolger spoke against the rezoning along with Mrs. Bolger and Mr. Holland. Mr. Karen Kmiemic of Historic,Landmarks Foundation spoke in opposition to the proposed rezoning along with David DuVall. Mr.Amaral noted that the physicians were approached by the current owners of the building because they were fearful to live in the neighborhood. Council Member Luecke voiced concern with regard to expanding the parking in this area. Following discussion, Council Member Zakrzewski made a motion, seconded by Council Member Slavinskas, to recommend Bill No. 99-94 favorably to Council. The vote was 2 in favor 1 opposed and 1 abstained. Therefore the vote did not prevail. Following further discussion, Council Member Duda made a motion, seconded by Council Member Washington, the Bill be sent to full Council without recommendation. The motion passed by a 3 to 1 vote with Council Member Zakrzewski abstaining. Mr. Bynori noted that when all professional uses except medical were taken out of "B"Iresidential that a study was begun by the Area Plan Staff however then both planners left the department. Under miscellaneous business Chief Marciniak was called upon by Council ki to give an update to the resent article which appeared in the USA Today. The Committee appreciated the update and Council member Washington noted that between 25% to 30% of the crimes committed in South Bend are committee by non residents of the City. Following discussion, the meeting was adjourned at 5:55 P.M.
