The September 12, 1994 meeting of the Zoning and Vacation Committee was called
to order by its Vice Chairperson, Council Member Cleo Washington at 4:17 P.M. in the
Council informal meeting room.
Persons in attendance included Council Members: Luecke, Washington, Kelly,
Puzzello, Zakrzewski, Coleman, Duda, and Ladewski; John Byorni, John McNamara,
William Eagan,Terry Bland,Mike Dansch,and Kathleen Cekanski-Farrand.
The first item on the agenda was to review Bill No.71-94 which is a zoning request
for the property located at 410 South Street. Mr. Byorni noted the the Bill is sent to the
Council with a favorable recommendation from the staff and the Area Plan Commission.
Mr.John McNamara made the presentation.He indicated that the rezoning is necessary for
the building of a two story home by Habitat for Humanity. In response to a question raised
by Council Member Luecke,it was noted that the proper BZA provisions regarding parking
have taken place and that those items addressed by the Department of Economic
Development have also been addressed.
In response to a question raised by Council Member Ladewski, Mr. McNamara
noted that such homes are typically 2/3 of the regular cost and that monthly payments on
interest free loans to Habitat range between $250.00 to $270.00 per month. Habitat g $ ab tat for

Habitat homes in St.Joseph County. Next year they are looking at the Rum Village area.
Following further discussion, Council Member Duda made a motion, seconded by
Council Member Zakrzewski, that Bill No. 71-94 be recommended favorably to Council.
The motion passed.
The Committee then reviewed Bill No. 72-94 which is a rezoning request for the
property located at 1359 Pyle Ave. Mr. Byorni noted that the staff and the Area Plan
Commission send a favorable recommendation to the Council.
The proposed"0"office district is requested on behalf of the Law Firm of Zappia,
Flagella, and Zappia according to Mr. Mike Danch. The land is currently vacant with this
being the site of where a home was destroyed due to an explosion. A one story brick
building is proposed at an approximate cost of $200,000.00 for 3 attorneys and 1 staff
person. Council President Puzzello voiced concern with regard to the "0" office use.
Council Member Coleman noted however that the proposed building would front Edison
and other commercial uses. Council Member Duda suggested that Edison Street be
requested as an address instead of Pyle Ave. Council Member er Ladewski voiced concern
over left turns onto Edison. Council Member Zakrzewski stated that he would like to hear
from the residents this evening before making a formal recommendation.
Upon further discussion, Council Member Zakrzewski made a motion, seconded
by Council Member Duda that Bill No. 72-94 be sent to Council without recommendation.
The motion passed.

The Committee then reviewed substitute Bill No. 70-94 which addresses zoning
regulations for Recycling Drop Centers. Mr. John Byorni that a meeting had taken place
after the last Common Council meeting to address the concerns raised. A substitute Bill
(copy attached) has been submitted as a result if that meeting. In light of the fact that it
contains substantial changes it is recommended that it be referred back to the Area Plan
Commission for further Public Hearing to be held on September 20, 1994 and then sent
back to the Common Council for a Public Hearing at its meeting of September 26, 1994.
Council Member Zakrzewski was concerned with regard to variance and how that would be
addressed in the proposed Bill. Mr. Byorni and the Council Attorney noted that both the
zoning regulations as well as the proposed permit procedure would address that area.
Following further discussion, Council Member Zakrzewski made a motion,
seconded by Council Member Duda, that substitute Bill No. 70-94 be sent to the Area Plan
Commission for Public Hearing on September 20,1994 and sent back to the Common
Council for Public Hearing on September 26,1994. The motion passed.
There being no further business to come before the Committee the meeting was
adjourned at 4:40 P.M.
