Zoning and Annexation Committee

The May 23, 1994 meeting of the Zoning and Annexation Committee was called to
order by it Chairperson, Council Member Lee Slavinskas at 4:50 P.M. in the Council
informal meeting room.
Persons in attendance included Council Members: Slavinskas, Luecke,
Washington, Kelly, Puzzello, Zakrzewski, Coleman, Duda, and Ladewski; Richard
Morgan, Ken Fedder, Dixie Turn, John Byorni, Don Porter, and Kathleen Cekanski-
Farrand.
The first item to be reviewed was substitute Bill No. 18-94 which is a zoning
request for the property located at 322 West Washington Ave. Mr. John Byorni noted that
the staff and the Area Plan Commission send to the Council with a favorable
recommendation. The proposed use for the property would be an advertising agency.
Following discussion, Council Member Duda made a motion seconded by Council
Member Zakrzewski that substitute Bill No. 18-94 be recommended favorably e avorabl to Council.
The motion passed.
The Committee then reviewed substitute Bill No. 19-94 which is a zoning request
for the property located at 910 Bruce Street. Mr. John Byorni noted that the request
received a favorably staff recommendation and also a favorable recommendation from the
Area Plan Commission. Mr. Richard Morgan made the presentation.He noted that this is a
third generation operating the Zahoran Funeral Home. If rezoned the petitioner would be
able to build a garage on the vacant lot so that there would be one central location. A
preliminary site plan was presented. Mr. Morgan notes that all contiguous property owners
have signed a petition in favor of the property.
Council Member Zakrzewski spoke in favor of the proposed rezoning.
Following discussion, Council Member Zakrzewski made a motion, seconded by
Council Member Washington that substitute Bill No. 19-94 be recommended favorably to
Council.The motion passed.
The Committee then reviewed Bill No. 20-94 which is a rezoning request for the
property located at 3900 Lincolnway West. Mr. John Byorni noted that the staff and the
Area Plan Commission send the petition with a favorable recommendation.
Mr. Ken Fedder made the presentation. Following discussion, Council
Member Zakrzewski made a motion, seconded by Council Member Duda that Bill No. 20-
94 be recommended favorably to Council. The motion passed.
The Committee the reviewed Bill No. 21-94 which is a rezoning request for the
North West corner of Windfall Drive and Summit Drive. Mr. John Byorni noted that both
the staff and the Area Plan Commission send the Bill to the Council with a favorable
recommendation. Following discussion, Council Member Washington made a motion,
seconded by Council Member Zakrzewski that Bill No. 21-94 be recommended favorably
to Council. The motion passed.

The Committee then reviewed Bill No. 30-94 which is initiated by the Common
Council "0" office district. Mr. John Byorni made the presentation. He stated that this
ordinance would be similar to the County "0" office which has been in existence for
several years. It would provide developmental standards and height and area restrictions.
Both the staff and the Commission send it to the Council with a favorable recommendation.
He noted that it removes much of the B residential zoning classifications. Mr.Slavinskas
spoke in favor of the proposed Bill.Following discussion, Council Member Duda made a
motion, seconded by Council Member Zakrzewski that Bill No. 30-94 be recommended
favorably to Council.The motion passed.
Mr. Byorni noted that there are several other items which the Area Plan staff are
working on which include a business park district planned for the area next to Project
2010, a miscellaneous ordinance to include areas of concern raised by Mr. Fozo, a
Recycling Drop Off Ordinance,and to streamline the final site plan procedures.
There being no further business to come before the Committee, the meeting was
adjourned at 5:15 P.M.
