HomeMy WebLinkAbout03-28-94 Zoning & Annexation Committee Report Zoning and Annexation Committee To the Common Council of the City of South Bend The March 28, 1994 meeting of the Zoning and Annexation Committee was called to order by it's Chairperson Councilmember Lee Slavinskas, at 4: 00 p.m. in the Council Informal Meeting room. Persons in attendance included Council Members Luecke, Washington, Kelly, Puzzello, Slavinskas, Coleman, Duda, and Ladewski ; Jon Oxian, Jon Byorni, Don Fozo, Don Porter, and Kathleen Cekanski-Farrand. The first item on the agenda was to review Resolution No. 94-23 which is a request from the Board of Zoning Appeals for the property located at 402 South Street. Don Fozo made the presentation. He noted that the petition is for Habitat for Humanity who is seeking a special exception for combined use and also seeking a various from the required ten (10) parking spaces to four (4) parking spaces. The Board of Zoning Appeals at it's meeting of March 17th recommended favorable the special use exception. Following discussion, Councilmember Duda made a motion, seconded by Council President Puzzello, that Resolution 94- 23 be recommended favorable to Council . The motion passed. Council Member Slavinskas then noted that he has filled Substitute Bill No. 90-93 . He noted that this was discussed by the Committee last fall. Inlight of current state law, a majority of the Common Council must agree to sponsor such a Bill before it can be forwarded to the area plan commission. Following discussion the majority of Councilmembers present agreed that they would sponsor the Bill for procedural purposes only. A letter to that affect was to be drafted and be sent by the Council Attorney to the are Plan Commission and the City Clerk. Mr. Oxian noted that he has spoken with Kathy Dempsey and Jon Hunt who appeared to be in favor of the proposal . This was made in response to a question raised by Council President Puzzello. Councilmember Slavinskas noted that the Substitute Bill incorporates a three (3) year period as opposed to a five (5) year period originally purposed by Mr. Oxian. Zoning and Annexation Committee March 28, 1994 Page 2 Council Member Slavinskas noted that a similar request is being made for Bill No. 30-94 which is a Zoning Ordinance to establish a new "0" office district. He noted that for the past year that members of the Council have been working with the area plan staff to develop this Ordinance. Again, a majority of the Council would be necessary in order to sponsor the Bill . The Councilmember present agreed to sponsor the Bill for procedural purposes only. The Council Attorney was directed to send a letter to that affect to the area plan commission as well as to the City Clerk. Mr. Byorni noted that Bill No. 30-94 is scheduled for the April Area Plan Commission meeting and that Bill No. 90-93 would be scheduled for the May area plan commission meeting upon receipt of the letter from the Council .
