HomeMy WebLinkAbout01-24-94 Zoning & Vacation Y • Zoning and Vacation Committee The Zoning and Vacation Committee was called to order by its Vice Chairperson, Council Member Cleo Washington, at 3 : 35 p.m. , in the Council Informal Meeting Room. Persons in attendance included Council Members: Puzzello, Ladewski, Luecke, Zakrzewski, Kelly, Duda, Coleman, and Washington; John Peddycord, Jenny Pitts Manier, Paul Cholis, John Byorni, Tom Walls, Ray Knead, Jeff Gibney, Don Porter, and Kathleen Cekanski-Farrand. Council Member Washington noted that the first item to be reviewed was Bill No. 95-93 which is a Bill to rezone the property located at 1512 West Fisher Street. Mr. John Byorni noted that a site plan is not required. He noted that both the staff and the Area Plan Commission recommend the Bill favorably to Council. Mr. Paul Cholis, the attorney for the Petitioner, then made a presentation. He stated that the woman who owns the property is currently a resident in a local nursing home. The property in question would be converted to a single family residential unit. He then showed pictures of the area in question. No formal action was taken on the Bill inlight of a lack of a quorum of the Committee. Council Member Washington then called for a presentation on Bill No. 3-94 , which is a rezoning request for the property located at 2403-5 and 2407-9 Lincoln Way West, 1054 Freemont Street and 1053 North Olive Street. Mr. John Byroni noted that the Area Plan Commission recommends the Bill favorably to Council. In light of a vacation request for one of the properties the Committee also heard a presentation on Bill No. 4-94 . Mr. John Peddycord, an attorney for the developer, made the presentation. He stated that a total of eight (8) lots are involved for a rezoning which would permit the development of a Hook's Pharmacy. The building would be 9 , 000 square feet and wouldThave a forty-eight (48) lot parking area. He noted that typically there would be two (2) trucks for delivery per week except at Christmas where the number may be as many as four (4) . He noted that with discussions with the City Administration that there would be a three (3) foot fence requirement which would require a variance and that the Pharmacy would not be a 24 hour operation. He also noted that Hook's plans to apply for a liquor license, however he anticipates a problem in light of a church being directly across the street. Zoning and Vacation January 24 , 1994 Page 2 It was noted that Bill No. 4-94 was amended with the consent of the Legal Department, with Mr. Pettycord required to provide copies of a Substitute Bill to the City Clerk's Office. Various questions regarding ingress and egress were raised by Council Member Ladewski; and Council Member Coleman raised questions with regard to lighting. Council Member Luecke questioned the abandoned gas station and its environmental concerns. It was noted that it was the former Marathon Station and had been vacant for approximately five (5) years. Council Member Luecke further noted that he sees the new zoning as a positive step. Jenny Pitts Manier, from the City Attorney's Office, noted that the Substitute Bill had been reviewed by Mary Hall Mueller and that it was acceptable to the City Administration. Following further discussion, Council Member Duda made a motion, seconded by Council Member Puzzello, that Bill No. 94-93 be recommended favorably to Council. The motion passed. Council Member Duda then made a motion, seconded by Council Member Puzzello, that to be Substituted Bill No. 4-94 be recommended favorably to Council . The motion passed. The next item to be reviewed was Bill No. 3-94 which is a vacation request. Mr. Jeff Gibney made the presentation. He noted that the vacation in question would permit the development of a Youth Development Center to be known as the "Charles Martin Annex" . He then provided a map (copy attached) and a brief history of the area. He noted that support from IUSB, Notre Dame, and the Art Center was very beneficial in having this project move forward. Council Member Kelly saw the project as being very positive. Council Member Ladewski questioned the payment paid by tenants, and was advised that the average is $4 . 50 per square foot with rent ranging from $3 . 40 per square foot to $5. 00 per square foot. For the record, Council Member Luecke noted that he works for South Bend Heritage, Inc. , but would not profit from the proposed development. Following further discussion, Council Member Duda made a motion, seconded by Council Member Puzzello, that Bill No. 3-94 be recommended favorably to Council. The motion passed. The Committee then reviewed Bill No. 109-93 which addresses Zoning and Vacation January 24 , 1994 Page 3 floodplain regulations. Mr. Byorni, of the Area Plan staff, made the presentation. He noted that this is required so that the local ordinance would be consistent with state and federal regulations. Following further discussion, Council Member Duda made a motion, seconded by Council Member Zakrzewski, that Bill No. 109-93 be recommended favorably to Council . The motion passed. The Council Attorney then provided a copy of a memorandum from Larry Magliozzi, Assistant Director of the Department of Community and Economic Development, on Bill No. 119-93 and Resolution No. 94-2 addressing the Reservoir Annexation. The memorandum sets forth the request that both items be continued to the meeting of February 28th.
