The August 10, 1992 meeting of the Zoning and Vacation Committee was called to order
by its Chairperson, Council Member Lee Slavinskas at 4:02 p.m. in the Council Informal
meeting room.
Persons in attendance included Council Members Luecke, Coleman, Puzzello,
Washington, Kelly, Slavinskas, Duda, Zakrzewski, and Ladewski; Mark Boveri, Grama
K. Bhagaban, Patrick Lynch, Larry Magliozci, Don Fozo, Mary Hall Mueller, John
Byorni,Don Porter, and Kathleen Cekanski-Farrand.
Council Member Slavinskas noted that the first item noted that the first item on the agenda
was to review Substitute Bill No.40-92 which is a rezoning request for Frances and Luther
Court. Mr. Mark Boveri of the Barnes and Thornburg Law Firm made the presentation.
He noted that he represents the Medical Arts Corporation and is requesting to change the
zoning from "B" to "C" and to change it to "F" height and area and order to allow
additional parking of sixty-five (65) parking spaces. He noted that previously an alley
vacation had been acted upon favorably by the Council.
Mr. Byorni noted that "F" height and area is needed because of the set back requirements.
It was also noted that the homes to be demolished are vacant and currently belong to the
Medical Arts Corporation. It was also noted that "F" height and area is required since the
parking is noncontiguous.
■ Mr. Byorni noted that both the staff and the Commission gave favorable recommendations
to this petition.
Following further discussion, Council Member Coleman made a motion seconded by
Council Member Puzzello, that Substitute Bill No. 40-92 be recommended favorably to
Council. The motion passed.
Council Member Ladewski stated that he would abstain from the voting this evening since
he is an employee of the Medical Arts Corporation.
The Committee then reviewed Substitute Bill No. 47-92 an annexation in Penn Township
and also Bill No. 48-92 which is a rezoning request for the area East of Topsfield
Development. Mr. Grama K. Bhagavan made the presentation. He noted that this is for
the development of fifty-two (52) single family homes in the price range of$300,000.00 to
$500,000.00. He also noted that there would be a temporary access road for construction
on to Inwood.
Council Member Slavinskas noted that the fiscal plan had been acted upon on at the last
meeting. Following favorable discussion, Council Member Coleman made a motion,
seconded by Council Member Puzzello that Substitute Bill No. 47-92 be recommended
favorably to Council. The motion passed.

Council Member Slavinskas noted that he had spoken with the developer and that the
access road would be in place with the proper signage. Council Member Coleman then
made a motion, seconded by Council Member Washington that Bill No. 48-92 be
recommended favorably to Council.The Motion passed.
The Committee then reviewed Bill No. 51-92 which is a rezoning request for the property
located at 925 West Washington. Mr.Patrick Lynch who will be living in the house made
the presentation. he noted that the rezoning is necessary to allow a duplex which was built
in 1867 to moved to the area. The house is being displaced in light of the museum. He
then showed pictures of the home in the area to the committee.
Mr. John Byorni noted that both the staff and the Commission gave favorable
recommendations to the proposed rezoning. If approved, the house will be moved
pursuant to approval by a board of public works on August 19, 1992.
Council Member Puzzello made a motion, seconded by Council Member Coleman,that Bill
No. 51-92 be recommended favorably to Council. The motion passed.
Council Member Slavinskas noted that Bill No. 54-92 is requested by the Petitioner to be
continued until August 24, 1992.
The Committee then reviewed Bill No. 39-92 which would amend Chapter 14 and Chapter
21 of the Municipal Code addressing swimming pools.
Mr. Don Fozo made the presentation along with Mary Mueller of the City Legal
Department. It was noted that there are two different definitions and two different
requirements in light of whether a swimming pool was built prior to September 13, 1989.
It was noted in response to a question raised by Council Member Zakrzewski that if there
are changes to the pool or the fence except for routine maintenance that the new standards
would apply.
Council Member Slavinskas noted that he still believes the biggest risk are the unattended
wading pools. In response to one of his questions it was noted that above ground pools do
not need an inspection nor permit but below ground pools do require a permit and as five
foot fence.
Council Member Puzzello noted that most of the states have four foot (4') limit and that
there is an additional cost involved to meet the five foot (5') standard. Mr. Fozo agreed
with her comments.
Mr. Byroni noted that the Area Plan Commission reviewed the zoning part only and
recommends it favorably to Council.

Following further discussion Council Member Coleman made a motion, seconded by
Council Member Washington that Bill No. 39-92 be recommended to Council. The motion
passed. There being no further business to come before the Committee the meeting was
adjourned at 4:35 p.m.
