The January 25, 1993 meeting of Zoning and Vacation Committee was called to order by
its Chairperson, Council Member Lee Slavinskas at 4:30 p.m. in the Council Informal
Meeting Room.
Persons in attendance included Council Members Luecke, Coleman, Puzzello,
Washington, Kelly, Slavinskas, Zakrzewski, Duda and Ladewski; John Byorni, Fred
Holycross, John Oxian, Joyce Boyler, Robert Canfield, Larry Magliozzi,Don Porter, Mr.
Niespodziany, and Kathleen Cekanski-Farrand.
It was noted for the record that Bill Nos. 46-92 (historic landmark proposal for 405 East
Ewing - Riley High School) and 101-92 (historic landmarkd request for 804 North
Lafayette - Madison Elementary School) would be continued indefinitely. Following
remarks by Mr. Oxian, Council President Luecke noted for the record that in light of the
upcoming Council Meeting which would be lengthy in light of the State of the City
Address, that there was an agreement to continued these proposed landmarks to a date in
the near future.
Council Member Slavinskas also noted that Bill No. 120-92 was being requested by the
Petitioner to be continued to the meeting of February 8, 1993.
Council Member Slavinskas noted that the next item to be reviewed is substitute Bill No.
84-92 which is a proposed historic district establishment for the property located at 514
East Indiana Avenue.
Mr. Oxian made the presentation. He noted that the property in question has some
maintenance problems. He also noted that the resident of the property is elderly, however
has been involved in the overall process. In response to questions raised by Council
Member Puzzello and Council Member Ladewski,it was noted that the overall maintenance
problems could be corrected with approximately $2,000.00 worth of improvements. Mr.
Oxian also stated that he hoped that "landmark status" would be traced through abstracts in
the future.
Council Member Ladewski requested a copy of a listing of all historical landmarks in both
the City and St. Joseph County.
Joyce Boyler of 1606 Hillsdale questioned whether the owner of the property is desirous of
this historic designation. She voiced concern in light of the fact that she is elderly.
Mr. Oxian stated that he met with the resident at her home and that she had agreed to sign a
consent form. He also stated that he does not believe that properties become devalued upon
receiving such a status.
Following further discussion, Council Member Coleman made a motion, seconded by
Council Member Puzzello, that Substitute Bill No. 84-92 be recommended favorably to
Council. The motion passed.

The Committee then reviewed Bill No. 108-92 which is a rezoning request for the property
located at 323 Ireland Road. Council Member Slavinskas noted that this is an amended
Bill.
Mr. Byroni noted that both the Area Plan Staff and the Area Plan Commission sends this
amended Bill to the Council with a favorable recommendation.

presentation. He stated that the site in question is the old Shakey's Pizza Parlor. He then
passed around pictures of the current facility located Erksine Plaza which will be relocated
to the new site. He stated that the building would be used for the operation of the

Following further discussion, Council Member Washington made a motion, seconded by
Council Member Coleman, that amended Bill 108-92 be recommended favorably to
Council. The motion passed.
Mr. Magliozzi then reviewed Bill Nos. 110-92, 111-92, 112-92, 113-92 and 114-92,
which all are "islands" to be annexed into the City limits. Total acreage involved in these
annexations would be 36 acres. He noted that the Economic Development Department sent
out letters to each of the property owners by regular mail.
The Council Attorney requested a copy of the letter which was sent and that in the future
that a listing of the names and addresses of all property owners sent such notice be
provided to the Chairperson of the Zoning and Vacation Committee.
Following further discussion, Council Member Puzzello made a motion, seconded by
Council Member Coleman, that Bill Nos. 110-92 through 114-92 be recommended
favorably to Council. The motion passed.
Council Member Slavinskas stated that in light of a representative from the Economic
Development Department being present that he would recommend that the Resolutions
addressing written fiscal plans, which were to be heard by the Personnel and Finance
Committee, be heard under his Committee under miscellaneous business. There was
acceptance of this recommendation.
Upon further discussion it was further recommended by Council Member Slavinskas that
the Committee and the Common Council not take action on Res. No. 93-9 which is the
fiscal plan for Ironwood/Killington in light of the many questions raised by this
annexation. Council Member Coleman made a motion seconded by Council Member
Puzzello that Res. No. 93-9 be continued until the meeting of February, 1993 for review
and discussion. The motion passed.
Mr. Magliozzi then reviewed Res. No. 93-4 which is the Muessel Fiscal Plan annexation.
It is of single ownership with all City services being available land would become effective
on April 16, 1993.

He then reviewed Res. No. 93-5 which is the written fiscal plan for the proposed annexed
area in Penn Township commonly referred to as the Kercheimer annexation. He noted that
this also is of single ownership, there are City services available, there would be no City
costs involved and that it would become effective on April 16, 1993.
Res. No. 93-6 which was the fiscal plan for the proposed annexed area in Penn Township
commonly known as the Kalyawonga annexation was then reviewed. He stated that this is
the largest area of approximately 14 acres. It also has City services available and would
become effective April 16, 1993.
Res. No. 93-7 which is the written fiscal plan for the proposed annexation in Clay
Township commonly known as the Stouffer annexation was then reviewed. This involves
single ownership of 11 acres which has City services available and would take effect on
April 16, 1993.
The last Resolution namely Res. No. 93-8 which if the written fiscal plan for the proposed
annexed area and Centre Township commonly known as the Hickey annexation was then
reviewed. This area is of single ownership and is approximately one acre and would take
effect April 16, 1993.

Following further discussion on each of these proposed fiscal plans, Council Member
Coleman made a motion, seconded by Council Member Puzzello, that Res. Nos. 93-4, 93-
i 5, 93-6, 93-7, and 93-8 be recommended favorably to Council. The motion passed.

There being no further business to come before the Committee the meeting was adjourned
at 5:15 p.m.
