HomeMy WebLinkAbout01-11-93 Zoning & Vacation tommtttuu Ztport ZONING AND VACATION COMMITTEE 10 tIje Common tout utl of tb8 City of £ioutfj The January 11, 1993 meeting of Zoning and Vacation Committee was called to order by its chairperson, Council Member Lee Slavinskas at 4:02 p.m. in the Council Informal Meeting Room. Persons in attendance included Council Members Washington, Duda, Puzzello, Luecke, Slavinskas, Kelly, Coleman, Ladewski; Ken Fedder, John Byroni, Michael Sklorenko, Larry Maliotzi,Don Porter, and Kathleen Cekanski-Farrand. The first item to be reviewed by the Committee was Bill No. 90-92 which is a zoning request for the property located at 2017 Lincolnway West. Mr. Ken Fedder, the attorney for Mr. Douglas S. Taelman, presented the Bill. He noted that he was before the City Council on September 14, 1992 and received favorable action on rezoning this to a (C-1) zoning classification. He noted that after that was completed that he was advised by the Area Plan Staff that a "C" classification would be necessary. Mr. Fedder noted that Mr. Taelman would live upstairs and have his beauty shop downstairs. Mr. Byroni noted that the Area Plan Commission gave a favorable recommendation to this request at its meeting December 15, 1992, however noted the Area Plan staff recommended the request unfavorably. Council Member Puzzello noted that she believes that this is a low intensity use and would be voting in favor of the proposed rezoning. Following further discussion, Council Member Puzzello made a motion, seconded by Council Member Washington, that Bill No. 90-92 be recommended favorably. The motion passed three to one with Council Member Coleman in the minority. The Committee then reviewed Bill No. 98-92 which is a substitute Bill. It is a zoning request for the property located at 3423 South Michigan Street. Mr . Michael Sklorenko made the presentation. He noted that the purpose of the rezoning is to allow the "J.E. Waltz" sign to be removed and to replace it with a "Busk Brother Furniture" sign instead. Mr. Byroni noted that both the Area Plan Commission and the staff gave a favorable recommendation. Following further discussion, Council Member Coleman made a motion, seconded by Council Member Washington, that substitute Bill No. 98-92 be recommended favorably to Council. The motion passed. Council Member Slavinskas noted that the staff of the Department of Economic Development has requested that Bill No. 120-92 be continued until the meeting of January 25, 1993. Zoning and Vacation Committee January 11, 1993 Page 2 The Committee then reviewed Bill No. 115-92 which would rescind Ordinance No. 8261- 92. Mr. Larry Magliozzi of the Department of Economic Development presented the Bill. He noted that this would rescind the prior annexation ordinance. He stated that in light of the Annexation Plan prepared by Cole Associates that the staff had made the decision to request that the prior annexation be rescinded. He also noted that the area in question is currently in litigation. Council Member Coleman stated that he did not believe that this would be precedent setting and that in light of the overall annexation plan that he believed that this was appropriate action. Council Member Slavinskas stated that the action taken by the Common Council in his opinion on the original annexation was proper, however he would vote in favor of this proposed Bill in light of the explanation given by the Department of Economic Development and the orderly development proposed by the Annexation Plan. Following further discussion, Council Member Coleman made a motion, seconded by Council Member Washington, that Bill No. 115-92 be recommended favorably to Council. The motion passed. The Council Attorney questioned Mr. Magliozzi whether the legal department had a staff attorney on board to assist in the annexation ordinances in light of the budget request for this position which was approved by the Common Council. Mr. Magliozzi stated that he was unaware of anyone being hired but would inform the Council once that is done. Council Member Slavinskas also requested that the new BZA resolution form be given to each of the Council Members by the Council Attorney. The Council Attorney also noted that a meeting of the Zoning and Vacation Committee will take place next Thursday, January 21, 1993 at 3:45 p.m. to discuss the 0-Zoning Ordinance. The meeting notice will have attached to it a draft of the 0-Zoning proposed bill.
