The October 11, 1993 meeting of the Zoning and Vacation
Committee was called to order by its Chairperson, Council
Member Lee Slavinskas, at 3 : 30 p.m. in the Council Informal
Meeting Room.
Persons in attendance included Council Members Luecke,
Coleman, Puzzello, Washington, Kelly, Slavinskas, Duda, and
Ladewski; Ken Fedder, Larry Magliozzi, Jon Hunt, Robert
Nagle, Don Porter, and Kathleen Cekanski-Farrand.
Council Member; Slavainskas, noted that the first item on the
agenda was to review Resolution No. 93-84 which is a written
Fiscal plan and policy to provide services to annexed area
and German Township (Shively-Demaeget Annexation)
Mr. Larry Magliozzi presented the resolution. He noted that
the Fiscal plan addresses 142 acres and if all phases are
passed by the Council, it would become effective
approximately December 23 , 1993 .
Mr. Ken Fedder the Attorney for Marilyn Brown stated that
she has owned the property indicated on a map attached to
the annexation since 1970. She owns 47 acres and the
proposed annexation would take in 36. 5 acres. This would
result in approximately 10 acres remaining in the County.
He stated that his client would like the City to revise
their legal description so that all property would be
included. Reference was then made to map three (3) .
Following further discussion Council Member Puzzello made a
motion seconded by Council Member Coleman to continue
Resolution No. 93-84 in light of the information recommended
by Mr. Fedder. The Resolution was continued until October
25, 1993 .
Council Member Coleman then made a motion seconded by
Council Member Puzello that Bill No. 82-93 which is the
Annexation Bill for the above described property addressed
in the Fiscal plan also be continued until October 25,
1993 . The motion passed.
The Committee then reviewed Resolution No. 93-77 which is a
petition from the Board of Zoning Appeals for the property
located at 833 South Ironwood Drive.
Mr. Ken Fedder made the presentation. He stated that a
special exception is being requested and was approved by
Zoning and Vacation Committee

the Board of Zoning Appeals in its meeting of September 17,
1993 . He noted that the property would have the house torn
down with one half being a parking lot and one half being a
green belt area. He also indicated where the fence line
would be. No cars would exit into the alley. The property
in question is the Walgreen property located at the corner
of Ironwood and Mishawaka Avenue.
Mr. Robert Nagle stated that this would assist with trucks
loading and unloading at the facility. He then showed a
site plan of the area.
Council Member Duda spoke in favor of the proposed request.
Following further discussion Council Member Coleman made a
motion seconded by Council Member Puzzello that Resolution
No. 93-77 be recommended favorably to Council. The motion
passed.
There being no further business to come before the
Committee, the;cmeeting was adjourned at 4 : 00 p.m.
