AMENDMENT TO OWNER-ENGINEER AGREEMENT Amendment No. 1 1.Background Data: a.Effective Date of Owner-Engineer Agreement: February 22, 2022 b.Owner:City of South Bend c.Engineer: A&Z Engineering, LLC d. Project: City’s 2022 Community Crossing Roadway Rehabilitation Project 122-024 2.Description of Modifications: EXHIBIT A – Engineer’s Services PART 2 – ADDITIONAL SERVICES A2.01 Additonal Services Requiring Owner’s Written Authorization A.If authorized in writing by Owner, Engineer shall furnish or obtain from others Additional Services of the type listed below. 7.Adding the Main Street On-Street Parking design, between Dean Street and Sherwood Street, to the original contract for 5-existing City Streets. The Owner and Engineer have agreed to add one additional City Street (Main Street) into the Original Contract. This addition has no impact on the original contract’s fees that were approved on February 22, 2022. The Main Street On-Street Parking Project shall be surveyed, designed, bid separately and constructed separately within the remaining fees from the original contract ($318,350). EXHIBIT B – Owner’s Responsibilities S.Complete agency fee and bond waiver forms and pay associated permit fees. C2.01 Compensation for Basic Services (other than Resident Project Representative)- Lump Sum Method of Payment A. Owner shall pay Engineer…Representative, if any, as follows: 1. A Total Compensation Amount Remains of $318,350 $274,850 based on the following estimated distribution of compensation: k.Adding the Main Street rehabilitation design plans for Not to Exceed Amount of $45,500 Break-up of item k: i. Preliminary Design Phase and City review $16,500 ii. Final Design Phase and City review $11,500 iii. Bidding and Negotiating Phase $10,000 iv. Construction Administration $7,500 B. Period of Service: The compensation amount stipulated in Compensation Packet BC-1 is conditioned on a period of service not exceeding 6 months. If such period of service is extended, the compensation amount for Engineer’s services shall be appropriately adjusted. Agreement Summary a.
