The December 14, 1992 meeting of Zoning and Vacation Committee was called to order by
its chairperson, Council Member Lee Slavinskas at 3:45 p.m. in the Council Informal
Meeting Room.
Persons in attendance included Council Members Luecke, Coleman, Puzzello,
Washington, Kelly, Slavinskas, Zakrzewski, Duda and Ladewski; John Byorni, Don
Fozo, Don Werthmeier, Norman Primus, Bob Nagle, Glenda Rae Hernadez, Kevin
Gorham,Ed Talley,Retha M. Kalka,Don Porter, and Kathleen Cekanski-Farrand.
Council Member Slavinskas noted that the City-Clerk's office had received a call from the
Petitioner regarding Resolution No. 92-87. If the Petitioner fails to provide a letter
requesting that this Resolution be withdrawn, it was recommended by the Building
Commissioner and the Council Attorney that the Council defeat the Resolution at this
evening's meeting.
The Committee then reviewed Bill No. 89-92 which would amend chapter 21 of the zoning
code. Mr. Byorni reviewed the Bill highlighting the changes in signage. Mr. Fozo gave
examples and briefly highlighted problems with previous enforcement. Council Member
Washington noted that he is currently in the process of attempting to purchase property
which would have a sign involved on the premise. The Council Attorney determined that
there would not be a conflict of interest on this matter.
Following further discussion, Council Member Coleman made a motion, seconded by
Council Member Puzzello, that Bill No. 89-92 be recommended favorably to Council. The
motion passed.
The Committee then reviewed Bill No. 102-92 which is a Bill to vacate certain property in
the first district. Mr. Kevin R. Gorham, the Petitioner, gave the presentation. He noted
that he has owned the affected properties for approximately four years. He showed
pictures of problems of vandalism in the area. He relayed problem of a crack house as well
as shootings in the area. He stated that he is attempting to protect the historic landmark
located at 729 Cottage Grove and more importantly is attempting to enhance the safety of
his tenants and neighbors. He anticipates barricading the area in question except for access
to the garage.
Council Member Slavinskas noted that the Board of Public Works gave a favorable
recommendation to this request. Mr. Ed Talley spoke in favor of the Bill. Council
President Luecke also spoke in favor of the Bill.
Following further discussion, Council Member Coleman made a motion, seconded by
Council Member Puzzello, that Bill No. 102-92 be recommended favorably to Council.
The motion passed.
The Committee then was to receive a report on Resolution No. 92-88 which is a Board of
Zoning appeals petition with regard to the property located at 1416 Mishawaka Avenue. A

presenter was not present. Mr. Fozo noted that the Board of Zoning appeals gave a
favorable recommendation to the petition by 3 to 1 margin. Council Member Coleman
made a motion, seconded by Council Member Puzzello, that the Resolution be sent to the
Council without recommendation. The motion passed.
The Committee then reviewed Resolution No. 92-89 which is a Board of Zoning Appeals
petition for the property located at 1716 South Michigan. Mr Don Werthmeier, the attorney
for the Petitioner, introduced his client, Mrs. Retha Kalka. He noted that this is a request
for special exception to have a combined use at the property.
Following further rther discussion, Council Member Coleman made a motion, seconded by
Council Member Puzzello, that Resolution No. 92-89 be recommended favorably to
Council. The motion passed.
The Council Attorney then requested further input from the Committee with regard to the
proposed form of resolution with regard to special exceptions. The Committee informally
decided to forward with the process so that special exceptions would be separated from
variances in the future.
It was also noted that Valley Engineering would have a representative available this evening
to review Resolution No. 92-88 and.Bill No. 92-92.
There being no further business to come before the Committee the meeting was adjourned
at 4:25 p.m.
