The May 11, 1992 meeting of the Zoning and Vacation Committee was called to order by
its Chairperson Council Member Lee Slavinskas at 3:45 p.m. in the Council Informal
meeting room.
Persons in attendance included Council Members: Luecke, Coleman, Puzzello,
Washington, Kelly, Slavinskas, Zakrzewski, Duda, Ladewski; Jenny Pitts Manier, John
Byorni, Robert Nagle, Sam Mercantini, Mr. and Mrs. Eugene Allen, Dave Schron, Don
Porter, Jack Hafferth, Dave Norris, Adaletta Tantu, members of the news media, and
Kathleen Cekanski-Farrand.
Council Members Slavinskas noted that the first item on the agenda was to review Bill No.
19-92 which is a Zoning Ordinance for 3445 Lincoln Way West and 3447 Lincoln Way
West Mr. Jack Hafferth gave the presentation. It was noted that this property has been re-
zoned to this classification in the past however, had not been developed. It was noted that
area plan both staff and commission gave favorable recommendations on the proposed Bill.
Following further comment, Council Member Coleman made a motion seconded by
Council Member Puzzello that Substitute Bill No. 19-92 be recommended favorably to
Council. The motion passed.
The Committee then reviewed Bill No. 22-92 which is an annexation ordinance. Mr. Dave
Norris, made the presentation. Mr. Norris noted that the City of South Bend needs the
proposed annexed property for future development of the City. Jenny Pitts Manier gave
supporting comments to the proposed annexation.
Mr.Dave Schron spoke in opposition focusing on drainage problems.
Mr. and Mrs. Eugene Allen of 17023 Hepler also spoke against the annexation. They
noted that seven acres of their property would be included within the annexation. These
seven acres were purchased by them in 1966.
Council Member Coleman spoke in favor of the proposed annexation.
Following further discussion, Council Member Coleman made a motion seconded by
Council Member Washington that Bill No. 22-92 be recommended favorably to council.
The motion passed.
Council Member Slavinskas noted that Bill No. 26-92 which is a vacation in the fourth
district has been requested to be continued to the next Council meeting by the petitioner.
The Committee then reviewed Resolution No. 92-37 which would approve a petition of the
South Bend Board of Zoning appeals on a special exception for a combined use on the
commercial property located at 1341 Dunham. Adaletta Tantu gave the presentation.
Mr. Robert Nagle stated that on April 16, 1992 the BCA recommended this request
favorably. Council Member Zakrezewski, the district Council Member also spoke in favor
of the proposed project.

Council President Luecke noted that current zoning laws do not allow this unless a special
exception is approved by the Council. It was also noted that a final site plan would be
forthcoming which would have the requirements of the Building Commissioner and the
State Fire Marshal.
Following further discussion Council Member Coleman made a motion seconded by
Council Member Washington that Resolution No. 92-37 be recommended favorably to
Council. The motion passed.
The Committee then reviewed Resolution No. 92-38 which would approve a petition from
the South Bend Board of Zoning Appeals on a special exception for recreational use on
Commercial property located at the Southwest corner of Lombardy and Meadow Lane.
Council Member Zakrzewski stated that this petition has been filed by Maurice Matthys
Little League so that the parking area could be upgraded.
Mr. Robert Nagle noted that the Board of Zoning Appeals gave a favorable
recommendation pursuant to Section 21-112 of the South Bend Municipal Code.
Following further discussion Council Member Coleman made a motion seconded by
Council Member Washington that Resolution No. 92-38 be recommended favorably to
Council. The motion passed.
The Committee then reviewed Resolution No.92-39 which would approve a petition of the
South Bend Board of Zoning Appeals on a special exception for combined use of
commercial property located at 1117 Western Avenue. Mr. Sam Mercantini gave the
presentation. He noted that there would be six apartments upstairs two of which would be
two bedrooms with the remaining being one bedroom and two commercial sites on the first
floor. The commercial uses would include a day care and a sports clothing consignment.
Eleven parking spaces would be provided.
Mr. Robert Nagle noted that the BCA gave a favorable recommendation at its meeting of
April 16, 1992. Council Member Ladewski questioned whether proper notice was given
and was advised that it was.
Following further discussion, Council Member Coleman made a motion seconded by
Council member Washington that Resolution No. 92-39 be recommended favorably to
Council. The motion passed.
There being no further business to come before the Committee the meeting was adjourned
at 4:20 p.m.
