RESOLUTION NO. 149
A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT AUTHORITY
APPROVING THE TRANSFER OF REAL PROPERTY TO THE SOUTH BEND
REDEVELOPMENT COMMISSION
WHEREAS, the South Bend Redevelopment Authority ("Authority") is the owner of a parcel
of real property situated in St. Joseph County, Indiana, more commonly known as the Palais Royale
Building, and described more particularly at Exhibit "A" ("Real Property"); and
WHEREAS, pursuant to Ind. Code § 36-7-14.5-12, the Authority may dispose of real property;

and
WHEREAS, pursuant to Ind. Code § 36-1-11-8, the Authority may exchange or transfer
property with another governmental entity upon terms and conditions agreed upon by the two (2)
entities as evidenced by the adoption of substantially identical resolutions of each entity; and
WHEREAS, pursuant to a motion approved at its meeting of November 27, 2002, the
Authority is desirous of transferring the Real Property to the City of South Bend, for the use and
benefit of its Department of Redevelopment so that the property may be sold for purposes of
development, which sale and transfer is subject to an easement for use and occupancy and retained by
the South Bend Redevelopment Authority.
NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND REDEVELOPMENT
AUTHORITY AS FOLLOWS THAT:
1. The transfer to the City of South Bend of the Real Property commonly known as the
Palais Royale Building situated in South Bend, St. Joseph County, Indiana, and
described more particularly at Exhibit "A" for the use and benefit of the City of South
Bend's Department of Redevelopment shall be, and hereby is, approved.
2. The President and Secretary of the Authority shall be, and hereby are, authorized
respectively, to execute and attest to the execution of a quitclaim deed conveying all
of the City of South Bend Redevelopment Authority's right, title and interest in and to
the Palais Royale Building to the City of South Bend, Indiana for the use and benefit
of its Department of Redevelopment upon the occurrence of the conditions set forth
immediately above, subject to an easement for use and occupancy preserved and
retained by the South Bend Redevelopment Authority.
3. This Resolution shall be in full force and effect upon its adoption.
ADOPTED at a meeting of the South Bend Redevelopment Authority held on December 18,
2002, at 1308 County-City Building, 227 West Jefferson Boulevard, South Bend, Indiana, 46601.

PALAIS ROYALE LEGAL DESCRIPTION
THAT PART OF THE NORTHWEST QUARTER OF SECTION 12, TOWNSHIP
37 NORTH, RANGE 2 EAST, PORTAGE TOWNSHIP, CITY OF SOUTH BEND,
ST. JOSEPH COUNTY, INDIANA WHICH IS DESCRIBED AS:
BEGINNING AT THE SOUTHEAST CORNER OF LOT #1 IN THE RECORDED
PLAT OF "MORRIS CIVIC MINOR SUBDIVISION" AS RECORDED IN
DOCUMENT N0.9836277 IN THE RECORDS OF THE ST. JOSEPH COUNTY,
INDIANA RECORDER'S OFFICE; THENCE ALONG THE SOUTH LINE OF
SAID LOT #1 N. 89°-47'-12" W., 165.98 FEET TO THE WEST LINE AND THE
SOUTHWEST CORNER OF SAID LOT #l; THENCE ALONG THE WEST LINE
OF SAID LOT #1 AND ITS LINE EXTENDED N. 00°-03'-42" E., 90.00 FEET;
THENCE S. 00°-10'-21" W., 90.00 FEET TO THE POINT OF BEGINNING.
