The September 9, 1991 meeting of the Zoning and Vacation
Committee was called to order by its chairperson, Council
Member Lee Slavinskas at 4:07 p.m. in the Council informal
meeting room.
Persons in attendance included Council Members: Slavinskas,
Coleman, Luecke, Duda, Zakrewski, Ladewski, Soderberg,
Puzzelo, and Niezgodkski; John Byorni, Frank Mulligan, Don
Porter, and Kathleen Cekanski-Farrand.
Council Member Slavinskas noted that the purpose of the Bill
was to review Substitute Bill No. 43-91, which is a Zoning
Ordinance specifically addressing "Sign Regulations. "
Council Member Slavinskas noted that a series of 4 feet by 8
feet billboards have appeared in recent political elections
in the fron yeards in residential areas. He has received
many comments from individuals seeking to prohibit such
signage. The Area Plan Commission recommended favorably the
Substitute Bill to the Common Council.
Council Member Zakrzewski voiced concern with regard to
whether thirty days was long enough prior to an election for
the posting of such political signs. He noted that he would
prefer a forty-five day limit. Council Member Duda also
voiced concern with regard to the time limitations.
Council Member Coleman stated that he believes the Bill is
basically a good idea and a good Bill. He noted, however,
that there should be some considerations to the following
items, such as many members of the public do not even
realize that an election is going on until they see the
political signs. He also voiced concern with regard to the
candidate who has a very small crew who may not be able to
post such signs within a thirty-day period and perhaps a
longer period of time would be more appropriate.
Council Member Luecke stated that there may be some
constitutional issues with regard to free speech if the time
limitation is not reasonable. He, therefore, made a motion,
seconded by Council Member Coleman to strike Subparagraph 2
from Section I (k) and to renumber Subparagraph 3 to become
Subparagraph 2. The motion passed.
Council Member Luecke also noted that the penalty in the
Bill is for the entire Article 10, thus all types of sign
regulations would be subject to the Ordinance violation of a
twenty-five ($25.00) dollar fine for the first offense and a
fifty ($50.00) dollar fine for subsequent offenses.
Questions were raised with regard to whether the Penalty
Section should be more specific as to whom the citation
would be issued and that it would be issued for each sign
found to be in violation of the Article. The Council
attorney noted that she would have the appropriate
amendatory language ready by the public hearing this
evening.
Following further discussion, Council Member Coleman made a
motion seconded by Council Member Luecke that Substitute
Bill No. 43-91, as amended, be sent to the Council with a
favorable recommendation. The motion passed.
In response to comments by Council Member Slavinskas that
amendments to Real Estate For Sale signs may need amendment,
Council Member Coleman suggested that he contact individuals
with the Board of Realtors for imput.
There being no further business to come before the
Committee, the meeting was adjourned at 4:30 p.m.
