HomeMy WebLinkAbout07-22-91 Zoning & Vacation Q nmmtttrr â– rpurt Zoning and Vacation Committee On tilt Q mmiwn fdounrtl of Up 014 of nut!! drub: The July 22, 1991 meeting of the Zoning and Vacation Committee was called to order by its Chairperson, Council Member Lee Slavinskas, at 4:34 p.m. in the Council Informal Meeting Room. Persons in attendance included Council Members: Zakrzewski, Duda, Coleman, Luecke, Niezgodski, Puzzello, Slavinskas, Coleman, Duda, Ladewski; Mike Dobson, John Byroni, John Oxian, Joanne Harper, Jim Pastor, two members of the public, a member of the news media, and Kathleen Cekanski-Farrand. Council Member Slavinskas noted that there were two items on the agenda for review. The first heard by the Committee was Bill No. 29-91 which was a zoning ordinance proposed for the property located at the Southwest corner of Ewing Avenue and Ironwood Roads. He noted that he would like to hold the public hearing in Committee and then would be recommending that it be continued at the regular Council Meeting to August 12, 1991. Mr. Mike Dobson the developer of the proposed site then showed a revised preliminary site plan to the Council. He noted that currently there is a two bay service station and that he would be adding a stockroom and new pump island with a canopy, with the new pump island to be placed to the West of the existing pumps. He noted that he is asking for twenty-three feet of forty-seven feet to be re-zoned commercial leaving a twenty-four foot residential area for screening. He noted that fifteen parking spaces are required four of which are proposed to be located on the West side of the property. Council Member Slavinskas noted that the residential lot is forty feet with seven feet of a vacated ally involved. It was also noted that the current underground tanks are six years old and do meet EPA requirements. Two concerned residents voiced opposition stating that they did not like the service bays to be located on the West side. They cited noise and odor problems which would result. They were also concerned with regard to the use of the alley which parallels Ewing. They voiced opposition to re-zoning the twenty-four feet of the forty-seven feet involved to C Commercial and voiced concern over losing a house in the area. John Byroni of the Area Plan Staff noted that they recommended that the service bay doors face Ewing in an attempt to reduce noise from this area. It is stated that the residents to the West would view a solid retaining wall plus a fence on top of that as opposed to viewing the doors of the bay area. Mr. Dobson noted that he has been in touch with Cole Associates and is using a five foot right of way for the expansion of Ironwood. Council Member Zakrzewski questioned whether they would be building a new building or utilizing the current structure. He was advised that they would utilize the current structure. Joanne Harper questioned whether any restriction of the use of the twenty-four foot residential area could be incorporated. it was noted by the council attorney and affirmed by Mr. Byroni of the Area Planned Staff that commitments or restrictive convents could be pursued. Mr. Jim Pastor the Survey Manager with Historic Preservation stated that they are concerned over the loss of building stock. He also stated that the proposed re-zoning would compromise the integrity of the neighborhood and opposes the C Commercial designation. Council Member Duda questioned the status of the Walnut Trees and was advised that as many as possible would be saved. Mr. Byroni noted that the Area Plan Commission sent the bill to the Common Council without recommendation. He stated that the staff recommendation was a denial. The reasons for the denial were that the proposed development was too intense and that they believed it was an expansion of C Commercial into a predominantly residential area. With the proposed revisions of the preliminary site plan and the deletion of the car wash the development is less intense but there is still an expansion of C Commercial in an A residential area. Mr. Byroni also noted that a variance procedure could be pursued however that would not be subject to a final site plan. Mr. Byroni also noted that they would be recommending that the exit on Ewing be closed and that the entrance on Ironwood be located as far South as practible. Council Member Slavinskas questioned the encroachment of the twenty-three feet into the residential area and believed that restrictions in the twenty-four foot buffer must be pursued. Council Member Zakrzewski questioned whether the building configuration could be changed to allow the bay doors to front Ironwood as opposed to Ewing. Mr. Dobson stated that in light of the mechanicals and the rest rooms located in the current facility that he did not desire to change the bay door area. Council Member Slavinskas stated that he saw this meeting as a fact-finding session and would be recommending that the bill be continued to the regular meeting of August 12. Following further discussion Council Member Zakrzewski made a motion seconded by Council President Niezgodski that Bill No. 29-91 be continued to the August 12 meeting. The motion passed. The Committee then reviewed Bill No. 41-91 which would establish a historic landmark for the property located at 609 Portage Avenue. Mr. Oxian the President of the Historic Preservation Commission noted that the building in question is ranked a "12". He stated that the former Mayor under the Progressive ticket in 1913 lived in the residence. Also the founder of the Whitcomb and Keller building lived at the residence. Council Member Luecke noted that the building is located within his district and that he is very much in favor of the, proposed designation. Following further discussion Council Member Luecke made a motion seconded by Council President Niezgodski that Bill No. 41-91 be recommended favorably to Council. The motion passed.
