HomeMy WebLinkAbout05-20-91 Zoning & Vacation Q n nmtt#rr &port ZONING AND VACATION COMMITTEE Jo the atommnn Moonlit of the OMR of Onu#h The May 20, 1991 Meeting of the Zoning and Vacation Committee was called to order by its Chairperson, Council Member Lee Slavinskas, at 4:00 p.m. in the Council Informal Meeting Room. Persons in attendance included Council Members Slavinskas, Ladewski, Niezgodski, Coleman, Puzzello, Duda, Zakrzewski, Soderberg, and Luecke; Jack Hofferth, John Byroni, Bernard Feeney, Pat Brown, Sergeant Jim Moon, Don Porter, and Kathleen Cekanski-Farrand. Council Member Slavinskas noted that under Special Business at this evening's meeting, we would be hearing two Resolutions which request approving Petitions of the South Bend Board of Zoning Appeals for use of the 4-H Fairgrounds. Resolution No. 91-36 is on behalf of the South Bend Shrine Circus, and Resolution No. 91-37 is on behalf of Sunrise Promotions, Inc. for their annual antique show. Council Member Slavinskas noted that he has received no remonstrance with regard to either of these use variances. The Committee then reviewed Amended Bill No. 16-91 which is a zoning request for the property located at 3425 Lincoln Way West and 3427 Lincoln Way West. Mr. Jack Hofferth, the representative on behalf of the Petitioner, noted that this is an amended Bill which includes only the frontage on Lincoln Way West. It incorporates approximately 1.4 acres. The back 115 feet to the north would remain as "A- Residential" . Mr. Hofferth noted that Arby's does not currently own their current location, and that a new Arby's would be constructed similar in style to the one located in Mishawaka. Council Member Niezgodski noted that this was in his District. He stated that he has received several complaints from neighbors with regard to litter and dumping. He suggested that No Trespassing signs be posted to address this problem. Mr. Hofferth stated that environmental study showed that the property was being used as a neighborhood compost area. Mr. John Byroni of the Area Plan Staff stated that initially they had concern with regard to a commercial use going to Elwood. With the amended Ordinance, the Area Plan Staff as well as the Commission was in favor of the proposed rezoning. He also noted that there would be no exit or entrance on the Elwood. 1 Zoning and Vacation Committee May 20, 1991 Page 2 Following further discussion, Council President Niezgodski made a motion seconded by Council Member Zakrzewski that Amended Bill 16-91 be recommended favorably to Council. The motion passed. The next item reviewed by the Committee was Amended Bill No. 17-91 which is a proposed rezoning for the property located at the southwest corner of the intersection of Jackson and Miami. Mr. Bernie Feeney of Lang, Feeney and Associates, Inc. , gave the presentation on behalf of Rojo Development, Inc. for the establishment of Hermitage South Estates. He noted that two previous annexations were involved with the first annexing into the City the eastern portion, and the second annexation becoming effective last Wednesday, May 15, 1991. The rezoning request is for "Al"- and "B-Residential". He further noted that in 1987 the South Bend Development Corporation purchased the property. Mr. Jack Hickey purchased the balance of it in 1990. Leroy Troyer and Associates developed the drainage plans, which call for five retention basins of which three have been constructed and are currently working. For a considerable period of time, Lang, Feeney and Associates have worked closely with the Area Plan staff and the City Engineering staff. They have proposed buffering the existing Residential with Residential. The County Engineer and the County Surveyor have approved the drainage proposals. Their plan proposes 2 . 3 times more drainage than what was originally proposed by the former developer. Mr. Feeney also noted that a side ditch along Johnson Road and Swales, have been incorporated so that water would not flow to impact Hay School. He also noted that an 18 inch culvert off of Miami would be plugged, thus placing 33 acres of water shed away from the Fairfax area. Council Slavinskas stated that the flow has stopped considerably since work has begun in this area. Mr. Feeney noted that the bottoms of retention basins would be lined, and that letters from the County Surveyor dated April 15th and From the Department of Public Works dated April 26th, are in favor of the drainage proposals. He stated that there was no remonstrance at the Area Plan meeting. Council Member Slavinskas also stated also that he has received no remonstrance calls. Mr. Feeney summarized by stating that all condominiums would be owner occupied. Within the "A-1" Duplex area, it would consist of 26.8 acres with 65 buildings, 106 units, with 4 units per acre. Within the "B-Residential" area it would be constructed on 8. 35 acres, incorporating 13 buildings with 48 units and not quite 6 units per acre. Following further discussion, Council Member Coleman made a motion seconded by Council Member Luecke, that amended Bill No. 17-91 be recommended favorably to Council. The motion passed. The Committee then reviewed Amended Bill No. 18-91 which is a proposed rezoning for the property located at 1001 Hickory Road. Mr. Pat Brown of Site Scopes reviewed the handout addressing the Hickory Park Office Center. He noted that the amendment was necessary to include the property presently occupied by WAMJ Radio Station. Following further discussion, . Council Member Coleman made a motion seconded by Council Member Niezgodski, that Amended Bill No. 18-91 be recommended favorably to Council. The motion passed.
