The February 25, 1991 meeting of the Zoning and Vacation
Commitee was called to order by its Chairperson, Council
Member Lee Slavinskas at 4:40 p.m. in the Council Informal
Meeting Room.
Persons in attendance included Council Members Luecke,
Niezgodski, Soderberg, Puzzello, Slavinskas, Zakrzewski,
Colmeman, Duda, and Ladewski; Mr. David Norris, Mr. Bernard
Feeney, Mr. Sean Allan, Jenny Pitts-Manier, members of the
new media, and Kathleen Cekanski-Farrand.
The first item on the agenda was to review Bill No. 7-91
which would vacate an alley near Leeland and Ashland.
The petitioner, Mr. Sean Allen, then gave the presentation.
He noted that he resides at 814 Ashland Avenue. He noted
that when he purchased the property there was a fence
located there since 1978. He added a new fence and moved a
shed toward the alley since it was not being used. He noted
that the alley was overgrown with weeds and bushes, and that
he cleaned the alley continuously. He was not aware that
there was an encroachment onto the alleyway until it was
brought to his attention. He noted that the fence and shed
extend 2 (two) inches into the alley.
Council Member Luecke, the District Councilman, noted that
the alley is for the full length of 180 feet. He stated that
the City does not use the alley, but that Mrs. Joyce
Kaniewski, who resides at 820 Ashland Avenue, does use the
alley for ingress/egress to her garage. It was further noted
that vacating one-half of the alley would create a dead end
alley and would not be acceptable. Council Member Luecke
noted that there was a need to keep it open.
Jenny Pitts-Manier noted that the Board may be receptive to
a vacation only for the portion where the fence and shed
extend into the alley.
The Council Attorney noted that the best route would be for
the petitioner to request a continuance at this evenings
meeting, and amend Bill 7-91 so , that he would not have to
pay an additional filing fee.
Council President Niezgodski noted that the previous owner
had encroached the alley, and that this was verified at the
Board of Public Works meeting.
Following further discussion, it was recommended that the
Bill be continued indefinitely by Council Member Slavinskas.

The Committee then reviewed Bill No. 8-91 which is an
annexation in Centre Township. Mr. Bernard Feeney,
representing the petitioner, stated that this area is just
south of Jackson Middle School and involves approximately 34
acres. He noted that this if for a development corporation
consisting of Jack Hickey.
Council Member Luecke questioned drainage plans for the
area. Mr. Feeney noted that he had met with Council Member
Duda and Council Member Slavinskas on that issue. The
drainage retention capacity is 2 1/2 times greater than the
one proposed by the County. There will be 4 basins
constructed in addition to those currently in existance. He
stated that 100% of the water from that area would be
retained with no new runoff. Mr. Feeney then showed the
drainage plan to the Committee.
Mr. Norris noted that the fiscal plan addressed in
Resolution 91-13 is on file for the property in question.
Following further discussion, Council Member Coleman made a
motion seconded by Council Member Zakrzewski that Bill No.
8-91 be recommended favorably to Council. The motion passed.
There being no further business to come before the
Committee, the meeting was adjourned at 4:56 p.m.
