ZONING AND VACATION COMMITTEE

The June 11, 1990, meeting of the Zoning and Vacation
Committee was called to order by its Chairperson, Council
Member Lee Slavinskas at 4:30 PM in the Council informal
meeting room.
Persons in attendance included Council Members Zakrzewski,
Coleman, Voorde, Niezgodski, Puzzello, Luecke, and Duda;
James Caldwell, Don Porter., Bruce C. Hammerschmidt, and
Kathleen Cekanski-Farrand.
Council Member Slavinskas noted that the first item on the
agenda was to review Bill No. 30-90 which would vacate an
alley near Navarre Street, Michigan and Main.
Mr. Bruce C. Hammerschmidt, an attorney representing
Memorial Hospital South Bend, Inc. , then made the
presentation. He noted that in 1958 and in 1972 when
Memorial Hospital buildings were constructed, it was
believed that all alleys were properly vacated. It was
noted, however, in a recent title search that one alley,
namely the one in 'question this evening, was never properly
vacated. The alley, as depicted on the map attached to the
proposed bill (copy attached) , indicates that it currently
goes through the center of the hospital complex. Mr.
Hammerschmidt noted that Board of Public Works gave a
favorable recommendation to the proposal.
Following further discussion by the Committee, Council
Member Luecke made a motion, seconded by Council Member
Coleman, that Bill No. 30-90 be recommended favorably to
Council. The motion passed.
Council Member Luecke noted that he had been working with
Patricia DeClercq on various zoning matters, one of which
included a more specific definition of who may live in a
single family dwelling. Council Member Slavinskas then
updated the Committee with regard to various meetings he had
had, and in particular, the concern raised by various
residents with regard to ingres, egres, and parking by
residential homes being used for the residentially
handicapped individuals.
There being no further business to come before the
Committee, it was adjourned at 4:45 PM.
