The June 11, 1990, meeting of the Public Safety Committee
was called to order by its Chairperson Council Member
William Soderberg at 5:05 P.M. in the Council Informal
meeting room.
Persons in attendance included Council Members Zakrewski,
Duda, Coleman, Luecke, Niezgodski, Soderberg, Puzzello,
Slavinskas, Voorde; Jenny Pitts Manier, Captain Friend, Mike
Meeks, Richard Nussbaum, Ron Glon, Don Porter, and Kathleen
Cekanski-Farrand.
Council Member Soderberg noted that the purpose of the
meeting was to discuss Substitute Bill No. 33-90 which would
amend the South Bend Municipal Code Chapter 20 entitled
"Vehicles in Traffic. "
Jenny Pitts Manier of the City's Legal Department then
passed out additional amendments to the Committee, namely,
pages 2 and 8 (copy attached) . She then highlighted that
changes in the Substitute Bill' and the Substitute Pages for
the Committee.
Mr. Michael Meeks of the Engineering Department noted that
basically the ordinance would update the language with
regard to new traffic laws designated by the state. He
specifically noted that changes required addressing
handicapped parking since the City of South Bend does not
issued local permits anymore.
Captain Friend then spoke in favor of the bill. He noted
that state handicapped parking permits can be procured
through the vocational rehabilitation office at 221 West
Wayne Street and also through Goodwill centers. He stated
that he believed that there would be better enforcement in
light of the proposed amendments.
Council Member Niezgodski questioned why there were many
references to "parking meters" throughout the ordinance. He
recommended that they be deleted since he was advised that
the City does not have any plans currently to go back to
parking meters.
Council Member Puzzello voiced concern with regard to
"Shoppers Park Free. " She noted that in fact charges of
$1.00 or more are being charged. Jenny Pitts Manier noted
that there is a validation in process and the Center City
Associates leases the property and therefore is in control
of the charges.

Council Member Luecke questioned the violation language and
proposed bill and also whether there was a need for a
definition of "parkway" to be included in the ordinance.
Jenny Pitts Manier noted that "parkway" is defined in
chapter 19 but not in chapter 20 of the Municipal Code.
Captain Friend noted that the Board of Public Works has the
authority to declare tow-away zones and that specific areas
throughout the downtown area have been so designated. All
other areas can be towed after a one hour violation.
Council Member Slavinskas raised question with regard to
tow-away zones and residential areas. Captain Friend noted
that permits for handicapped parking are issued to the
persons and not to the vehicle and therefore the permits
could be transfeered from vehicle to vehicle. Council
Member Luecke also raised questions with regard to temporary
signs addressed in Section 20-13.
Following further discussion, Council Member Slavinskas made
a motion, seconded by Council Member Puzzello, that amended
Substitute Bill No. 33-90 be recommended favorably to
Council. The motion passed.
There being no further business to come before the
Committee, the meeting was adjourned at 5:30 P.M.
